TITLE OF BILL:

An act to amend the alcoholic beverage control law, in relation to
providing alcoholic beverages on credit to an individual person

 
PURPOSE OR GENERAL IDEA OF BILL:

To permit alcoholic beverage retailers to extend store credit to indi-
viduals on orders of at least $200.

 
SUMMARY OF SPECIFIC PROVISIONS:

Section one amends the alcoholic beverage control law by adding a new
subdivision 6-a which states that notwithstanding the provisions of
subdivision five of section 100 of the alcoholic and beverage control
law, a retail licensee for off-premises consumption may sell, deliver,
give away, hold or store, or cause, permit or procure to be sold, deliv-
ered, given away, held or stored, any alcoholic beverage on credit to
any individual person, provided that the order on credit is at least two
              

hundred dollars. This exemption applies even if the retail licensee
retains the alcoholic beverage for the individual person.

Section two provides the effective date.

 
JUSTIFICATION:

Currently, a wine and liquor retailer may accept credit cards for
payment of merchandise, but may not extend its own credit. This is often
problematic for individual wine collectors, who are usually contacted by
retail licensees with potential purchases.- Often these customers do not
even pick up their purchase, and the retail licensee places their order
in storage. By lifting this restriction, wine and liquor retailers can
bill though the use of an invoice, while still retaining the customer's
purchase, and operate in conformance with standard business practices.
