TITLE OF BILL:

An act to amend the vehicle and traffic law, in relation to certain
tolls paid by certain vehicles to the central business district

 
PURPOSE:

The purpose of this act is to provide toll relief to drivers who use the
NYC Central Business District the least and therefore contribute to
congestion the least

 
SUMMARY OF PROVISIONS:

Section 1 amends subdivision 1704-a of the vehicle and traffic law,
being consistent with the goals of reducing traffic congestion, author-
izing the Triborough bridge and tunnel authority to establish, charge,
and collect tolls entering the central business district only on and
after the thirteenth visit as indicated via the electronic toll
collection system.

Section 2 establishes the effective date.

 
JUSTIFICATION:

New York City is designed with many necessary resources and government
services consolidated within the central business district (CBD).

However, our transit system still does not adequately service the needs
of all New Yorkers. Seniors, parents with strollers, immunocompromised
persons, and those living in transit deserts experience limitations for
various reasons. Among those reasons are a lack of accessibility, unre-
liable or inconsistent service, or service simply out of reach. Others
avoid public transit due to trauma they experienced as victims of
crimes.

These New Yorkers must travel to the central business district occa-
sionally but not regularly. On those occasions they are unable to take
public transit and opt to drive out of necessity-not convenience. Their
use is limited and therefore they are not the root cause of the
congestion.

This legislation provides relief to the least frequent New Yorkers who
travel to the CBD by waiving the first twelve visits, to approximate
once a month visits; charges would be incurred for the thirteenth and
beyond.

When a cancer patient needs to visit a specialist in Manhattan once a
year for a follow-up, they're not getting tolled for lifesaving care.

When a family with a newborn baby or a person with a compromised immune
system who can't be in a train car full of people, or a person in a two
fair zone, living almost a mile from public transit, needs to access
government services in the CBD, they shouldn't have to bear the cost.



When a train line is out of service repaired and someone opts to drive
once or twice, they should be to work without taking an additional bite
out of their paycheck.

This program will not only provide economic relief to those New Yorkers
but also incentivizes other New Yorkers to increase their use of public
transit over driving to the CBD. The effect of which will be a decrease
in vehicle congestion into the CBD, the defined goal of congestion pric-
ing.

 AN ACT to amend the vehicle and traffic  law,  in  relation  to  certain
   tolls paid by certain vehicles to the central business district
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision 1 of section 1704-a of the vehicle and  traffic
 law, as added by section 1 of subpart A of part ZZZ of chapter 59 of the
 laws of 2019, is amended to read as follows:
   1. Consistent with the goals of reducing traffic congestion within the
 central  business  district  and funding capital projects the Triborough
 bridge and tunnel authority shall have the power, subject to  agreements
 with its bondholders, and applicable federal law to establish and charge
 variable  tolls  and  fees  for  vehicles  entering  or remaining in the
 central business district at any time and shall have the power,  subject
 to agreements with bondholders, and applicable federal law to make rules
 and regulations for the establishment and collection of central business
 district  tolls, fees, and other charges. For purposes of establishing a
 central business district toll or tolls the  board  shall,  at  minimum,
 ensure annual revenues and fees collected under such program, less costs
 of  operation  of  the  same,  provide  for sufficient revenues into the
 central business district  tolling  capital  lockbox  fund,  established
 pursuant to section five hundred fifty-three-j of the public authorities
 law  necessary  to fund fifteen billion dollars for capital projects for
 the 2020 to 2024 MTA capital program, and any additional revenues  above
 that amount to be available for any successor programs. Additionally, no
 toll  may  be  established  and charged on passenger vehicles registered
 pursuant to subdivision six of section four hundred one of this  chapter
 more  than  once  per  day for purposes of entering the central business
 district.   ADDITIONALLY,  NO  TOLL  MAY  BE  ESTABLISHED,  CHARGED  AND
 COLLECTED  ON  ANY VEHICLE ENTERING THE CENTRAL BUSINESS DISTRICT IN ANY
