TITLE OF BILL:

An act to amend the executive law, in relation to minority and women-
owned business enterprise applicants for the medical cannabis or adult-
use cannabis industries

 
SUMMARY OF SPECIFIC PROVISIONS:

Section one requires the director of the division of minority and
women's business development in the department of economic development
to establish a procedure to grant temporary certification to minority
and women-owned business enterprise applicants which attest that the
business enterprise is intending to participate in the medical cannabis
or adult-use cannabis industries. Such certification shall be granted
within sixty days of submission of the application and shall be in
effect until the office approves, denies, or revokes such certification
or any subsequent certification. Such temporary certification shall be
governed by all the rules and regulations applicable pursuant to this
article.

Section two provides the effective date.

 
JUSTIFICATION:

Earlier this year, New York took the historic step of legalizing adult-
use cannabis. This legislation, in part, created a social and economic
equity program to encourage those most disproportionately impacted by
cannabis enforcement to participate in this new industry.  To that end,
there is a goal for 50% of the licenses under this program to be granted
to equity participants, such as minority and women-owned businesses
(MWBEs).

Parallel to this, New York has a process for MWBEs to be certified as
such. However, this program can take an extensive amount of time, and
there is currently no alternative for those who need certification
quickly. This bill would create a temporary certification process for
MWBEs who are intending to participate in the medical cannabis or
adult-use cannabis industries. This interim certification would enable
newly formed MWBEs to become involved in the cannabis space and apply
for a license with the Office of Cannabis Management much more quickly,
thus helping the state meet its social and economic equity goals.

 AN ACT to amend the executive law, in relation to  minority  and  women-
   owned  business  enterprise  applicants  for  the  medical cannabis or
   adult-use cannabis industries

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.    Section 314 of the executive is amended by adding a new
 subdivision 2-d to read as follows:
   2-D. THE DIRECTOR SHALL ESTABLISH A PROCEDURE ENABLING THE  OFFICE  TO
 GRANT  TEMPORARY  CERTIFICATION  TO  MINORITY  AND  WOMEN-OWNED BUSINESS
 ENTERPRISE APPLICANTS WHICH ATTEST IN THE CERTIFICATION APPLICATION THAT
 THE BUSINESS ENTERPRISE IS  INTENDING  TO  PARTICIPATE  IN  THE  MEDICAL
 CANNABIS  OR  ADULT-USE CANNABIS INDUSTRIES PURSUANT TO ARTICLES TWO AND
 THREE OF THE CANNABIS LAW, RESPECTIVELY.   SUCH TEMPORARY  CERTIFICATION
 SHALL  BE  GRANTED  WITHIN SIXTY DAYS OF SUBMISSION OF SUCH APPLICATION,
 AND SHALL BE IN EFFECT UNTIL THE OFFICE  APPROVES,  DENIES,  OR  REVOKES
 SUCH  CERTIFICATION  OR  ANY  SUBSEQUENT CERTIFICATION.   SUCH TEMPORARY
 CERTIFICATION SHALL BE GOVERNED BY ALL THE RULES AND REGULATIONS  APPLI-
 CABLE PURSUANT TO THIS ARTICLE.
   §  2.  This act shall take effect immediately; provided, however, that
 the amendments to section 314 of the executive law made by  section  one
 of  this  act  shall  not affect the repeal of such section and shall be
 deemed to be repealed therewith.
