Provides that the director of the division of minority and women's business development shall establish a procedure enabling the office to grant temporary certification to minority and women-owned business enterprise applicants which attest in the certification application that the business enterprise is intending to participate in the medical cannabis or adult-use cannabis industries.

   printed to be committed to the Committee on Procurement and Contracts
 
 AN ACT to amend the executive law, in relation to  minority  and  women-
   owned  business  enterprise  applicants  for  the  medical cannabis or
   adult-use cannabis industries

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.    Section 314 of the executive is amended by adding a new
 subdivision 2-d to read as follows:
   2-D. THE DIRECTOR SHALL ESTABLISH A PROCEDURE ENABLING THE  OFFICE  TO
 GRANT  TEMPORARY  CERTIFICATION  TO  MINORITY  AND  WOMEN-OWNED BUSINESS
 ENTERPRISE APPLICANTS WHICH ATTEST IN THE CERTIFICATION APPLICATION THAT
 THE BUSINESS ENTERPRISE IS  INTENDING  TO  PARTICIPATE  IN  THE  MEDICAL
 CANNABIS  OR  ADULT-USE CANNABIS INDUSTRIES PURSUANT TO ARTICLES TWO AND
 THREE OF THE CANNABIS LAW, RESPECTIVELY.   SUCH TEMPORARY  CERTIFICATION
 SHALL  BE  GRANTED  WITHIN SIXTY DAYS OF SUBMISSION OF SUCH APPLICATION,
 AND SHALL BE IN EFFECT UNTIL THE OFFICE  APPROVES,  DENIES,  OR  REVOKES
 SUCH  CERTIFICATION  OR  ANY  SUBSEQUENT CERTIFICATION.   SUCH TEMPORARY
 CERTIFICATION SHALL BE GOVERNED BY ALL THE RULES AND REGULATIONS  APPLI-
 CABLE PURSUANT TO THIS ARTICLE.
   §  2.  This act shall take effect immediately; provided, however, that
 the amendments to section 314 of the executive law made by  section  one
 of  this  act  shall  not affect the repeal of such section and shall be
 deemed to be repealed therewith.
