TITLE OF BILL:

An act to amend the public buildings law, in relation to requiring
gender neutral bathrooms in state-owned buildings

 
PURPOSE:

To require that all government owned and operated buildings and facili-
ties have at least one all gender restroom.

 
SUMMARY OF PROVISIONS:

Section 1 amends section 145 of the public buildings law by adding a new
paragraph e to subdivision 1 and adding two new subdivisions 1-a and 3
to require at least one all gender multiple-occupancy bathroom in state-
owned and operated buildings where there are no all gender single-occu-
pancy bathrooms.

Section 2 provides the effective date.

 
JUSTIFICATION:

New York'State law requires that all government owned and operated
buildings have at least one all gender single-occupancy bathroom. In
buildings that do not have a single-occupancy bathroom, however, indi-
viduals are forced to use a gendered multiple-occupancy bathroom which
may not correspond with their gender identity.

According to a 2022 report released by the New York State Department of
Health .5% of the total state population, and 1.5% of the 18 to 24 year-
old population in NYS identify as transgender or gender nonconforming.

All government buildings should offer at least one all gender bathroom
even if they do not have a single-occupancy bathroom. Every New Yorker
should have access to a bathroom where.they feel safe and comfortable.

 AN ACT to amend the public  buildings  law,  in  relation  to  requiring
   gender neutral bathrooms in state-owned buildings
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The section heading of section 145 of the public  buildings
 law,  as amended by chapter 14 of the laws of 2020, is amended, subdivi-
 sion 1 is amended by adding a new paragraph (e), and  two  new  subdivi-
 sions 1-a and 3 are added to read as follows:
   Gender neutral [single-occupancy] bathrooms.
   (E)  "MULTIPLE-OCCUPANCY  BATHROOM"  MEANS  A  ROOM  OR SUITE OF ROOMS
 CONTAINING AT LEAST ONE SINK AND AT LEAST TWO SANITARY FIXTURES, SUCH AS
 TOILETS OR URINALS, INTENDED FOR SIMULTANEOUS USE BY TWO OR  MORE  OCCU-
 PANTS.
   1-A.  ALL  STATE-OWNED  BUILDINGS AND, WHERE PRACTICABLE, STATE-LEASED
 BUILDINGS SHALL INCLUDE GENDER NEUTRAL BATHROOMS.
   3. WHEN A STATE AGENCY IS UNABLE TO COMPLY  WITH  SUBDIVISION  TWO  OF
 THIS  SECTION, SUCH STATE AGENCY SHALL ENSURE THAT THERE IS AT LEAST ONE
 GENDER NEUTRAL MULTIPLE-OCCUPANCY BATHROOM IN THE STATE-OWNED  BUILDINGS
 UNDER  ITS  JURISDICTION  AND,  WHERE  PRACTICABLE,  IN THE STATE-LEASED
 BUILDINGS UNDER ITS JURISDICTION.
   § 2. This act shall take effect on the ninetieth day  after  it  shall

AMENDED BILL:

The "A" print of the bill makes technical changes and clarifies that the
requirement of at least one gender-neutral multiple-occupancy bathroom
in state buildings is based on the extent to which it is practicable.
