 Introduced  by  Sen.  MAY  --  read  twice and ordered printed, and when
   printed to be committed to the Committee on Disabilities
 
 AN ACT to amend the education law, in relation to requiring funding  for
   special  education  services  and programs for preschool children with
   disabilities to cover full-day joint classroom instruction

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section  4410 of the education law is amended by adding a
 new subdivision 14 to read as follows:
   14. FULL-DAY SPECIAL  EDUCATION  FUNDING.  ANY  SCHOOL  DISTRICT  THAT
 RECEIVES  FUNDS FOR SPECIAL EDUCATION SERVICES OR PROGRAMS FOR PRESCHOOL
 CHILDREN WITH DISABILITIES PURSUANT TO THIS SECTION, AND  THAT  RECEIVES
 FUNDS  FOR  FEDERAL  AND/OR STATEWIDE UNIVERSAL PREKINDERGARTEN PROGRAMS
 PURSUANT TO SECTION THIRTY-SIX HUNDRED TWO-E AND/OR  SECTION  THIRTY-SIX
 HUNDRED  TWO-EE  OF  THIS  CHAPTER,  SHALL  BE MANDATED TO OPERATE JOINT
 CLASSROOM  INSTRUCTION  FOR  PRESCHOOL  CHILDREN  WHO  REQUIRE   SPECIAL
 SERVICES OR PROGRAMS UNDER THIS SECTION, AND OTHER CHILDREN FOR THE SAME
 NUMBER  OF  HOURS  EACH DAY.   THE DEPARTMENT SHALL PROMULGATE ANY RULES
 AND/OR REGULATIONS NECESSARY TO IMPLEMENT THE PROVISIONS OF THIS  SUBDI-
 VISION.
   § 2. This act shall take effect immediately.
