   printed to be committed to the Committee on Codes
 
 AN ACT to amend the penal law, in relation to establishing the crime  of
   staging a construction site accident
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The penal law is amended by adding a new section 176.85  to
 read as follows:
 § 176.85 STAGING A CONSTRUCTION SITE ACCIDENT.
   A  PERSON IS GUILTY OF STAGING A CONSTRUCTION SITE ACCIDENT WHEN, WITH
 INTENT TO COMMIT AND IN FURTHERANCE OF A FRAUDULENT INSURANCE ACT, HE OR
 SHE ENTERS A CONSTRUCTION SITE AND INTENTIONALLY STAGES AN  ACCIDENT  ON
 SUCH SITE WITH THE INTENT TO FILE AN INSURANCE CLAIM.
   STAGING A CONSTRUCTION SITE ACCIDENT IS A CLASS E FELONY.
   § 2. This act shall take effect on the one hundred eightieth day after

 HIRES,  REQUESTS, ENCOURAGES, ORCHESTRATES OR INVITES ANOTHER INDIVIDUAL
 TO ENTER A CONSTRUCTION SITE AND INTENTIONALLY STAGE AN ACCIDENT ON SUCH
 SITE WITH THE INTENT TO FILE AN INSURANCE CLAIM.
   STAGING A CONSTRUCTION SITE ACCIDENT IS A CLASS E FELONY.
