TITLE OF BILL:

An act in relation to establishing the climate leadership and community
protection act cost task force

 
PURPOSE:

To establish the Climate Leadership and Community Protection Act cost
task force.

 
SUMMARY OF PROVISIONS:

Section 1. Climate leadership and community protection act cost task-
force. 1. There is hereby created, within the New York state energy
research and development authority, a climate leadership and community
protection act cost task force, which shall consist of fourteen members
to be appointed as follows

Section 2. This act shall take effect immediately.

 
JUSTIFICATION:

With New York State's decision to rapidly move away from clean natural
gas and other energy sources, the unfortunate reality is that there are
some issues with the efforts to comply with the CLCPA (Climate Leader-
ship and Community Protection Act) and that may impact every day New
Yorkers. Many in the energy industry have expressed serious concerns
that the cost estimates associated with the CLCPA mandates have been
woefully short of the true cost to ratepayers and that the current ener-
gy infrastructure will be unable to handle demand that the CLPCA will
put on it.

Due to these concerns, and others, our state must take immediate steps
to ensure that ratepayers know exactly what this will cost them. This
task force will focus on the impact on taxpayers and ratepayers of the
mandates set forth by the CLCPA. Ratepayers need to know what their
monthly bills could be, how much this will cost municipalities for
infrastructure needs and what the cost could be to business.

While the CLCPA implementation is still flawed, we must move forward
with a clear plan to protect our residents from exceedingly increasing
costs. This bill will help find those answers to protect New York resi-
dents.

 AN  ACT in relation to establishing the climate leadership and community
   protection act cost task force
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section  1.  Climate leadership and community protection act cost task
 force. 1. There is hereby created, within  the  New  York  state  energy
 research  and  development authority, a climate leadership and community
 protection act cost task force, which shall consist of fourteen  members
 to be appointed as follows:
   (a)  The  president of the New York state energy research and develop-
 ment authority or their designee;
   (b) The commissioner of environmental conservation or their designee;
   (c) The commissioner of the department  of  public  service  or  their
 designee;
   (d) The president of the New York power authority or their designee;
   (e) One member to be appointed by the governor;
   (f)  One  member  to  be  appointed  by the temporary president of the
 senate;
   (g) One member to be appointed by the speaker of the assembly;
   (h) One member to be appointed by the minority leader of the senate;
   (i) One member to be appointed by the minority leader of the assembly;
   (j) One member to be appointed by the New York energy coalition;
   (k) One member to be appointed by the independent power  producers  of
 New York;
   (l)  One  member to be appointed by New York independent system opera-
 tor;
   (m) One member to be appointed by the business  council  of  New  York
 state; and
   (n) One member to be appointed by the largest group representing rate-
 payers.

   2.  The  at-large  members  shall have expertise in one or more of the
 following areas: utility management, electrical engineering,  economics,
 finance, electrical infrastructure development, or power production.
   3. Task force members shall receive no compensation for their services
 but  shall  be  reimbursed for actual and necessary expenses incurred in
 the performance of their duties.
   4. The chairperson of the task force shall be voted  on  by  the  task
 force  members.  The task force shall meet no less than six times and at
 other times at the call of the chairperson.
   5. All members shall be appointed no later than sixty  days  following
 the effective date of this act. Any vacancies on the task force shall be
 filled in the manner provided for in the initial appointment.
   6.  The  task  force  shall  be authorized to hold public hearings and
 meetings to enable it to accomplish its duties.
   7. The task force  may  consult  with  any  organization,  educational
 institution, other government entity or agency or person in the develop-
 ment of its report required by subdivision 10 of this section.
   8.  The New York state energy research and development authority shall
 provide the task force with such facilities, assistance and data as will
 enable the task force to carry out its powers and duties.  Additionally,
 all  other  agencies  of the state or subdivisions thereof shall, at the
 request of the chairperson, provide the task force with such facilities,
 assistance, and data as will enable the task  force  to  carry  out  its
 powers and duties.
   9.  The purpose of the climate leadership and community protection act
 cost task force shall be to study the impact on taxpayers and ratepayers
 of the implementation of the mandates set forth by the  climate  leader-
 ship and community protection act (CLCPA) including, but not limited to:
   (a) the impact on monthly bills for ratepayers;
   (b)  the total cost of spending by the state of New York to meet CLCPA
 mandates;
   (c) the total cost of any tax credits to state revenues;
   (d) the cost to municipalities for infrastructure  development  needed
 to meet electrification requirements;
   (e) the cost for businesses to convert manufacturing processes to meet
 emissions goals; and
   (f)  the  cost to school districts to convert school buses to electric
 and to adopt renewable energy power sources.
   10. No later than December 31, 2025 the task force shall submit to the
 governor and the legislature a report detailing its findings and provide
 recommendations for legislation to implement its recommendations.
   § 2. This act shall take effect immediately.
