 AN ACT to amend the public health law, in relation to  hospital  compli-
   ance with federal hospital price transparency law and rules
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Section 2805 of the public health law is amended by  adding
 a new subdivision 3 to read as follows:
   3.  (A)  THE  COMMISSIONER SHALL REPORT MONTHLY ON HOSPITAL COMPLIANCE
 WITH FEDERAL HOSPITAL PRICE TRANSPARENCY  LAW  AND  RULES.  SUCH  REPORT
 SHALL BE CONSPICUOUSLY POSTED ON THE DEPARTMENT'S WEBSITE.
   (B)  EFFECTIVE  APRIL  FIRST,  TWO THOUSAND TWENTY-FIVE, NO   HOSPITAL
 SHALL ACCESS ANY FUNDS PURSUANT TO SECTION TWENTY-EIGHT HUNDRED  SEVEN-K
 OF  THIS  ARTICLE  IF  THEY  ARE NOT IN MATERIAL COMPLIANCE WITH FEDERAL
 PRICE TRANSPARENCY LAW, RULES AND REGULATIONS.    THE  COMMISSIONER  MAY
 ALLOW CONTINUED OPERATION IF SUCH COMMISSIONER DEEMS THE FACILITY ESSEN-
 TIAL AND IS MAKING PROGRESS TOWARDS COMPLIANCE WITH FEDERAL PRICE TRANS-
 PARENCY  LAW, RULES AND REGULATIONS. SUCH DETERMINATION SHALL BE MADE ON
 A YEARLY BASIS.
   § 2. This act shall take effect on the one hundred eightieth day after
 it shall have become a law. Effective immediately, the addition,  amend-
 ment and/or repeal of any rule or regulation necessary for the implemen-
 tation  of  this act on its effective date are authorized to be made and
 completed on or before such effective date.

 AN  ACT  to amend the public health law, in relation to hospital compli-

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
