BILL NUMBER: S9027 SPONSOR: CLEARE TITLE OF BILL: An act to amend the executive law, in relation to requiring the instal- lation and maintenance of outdoor lithium-ion battery charging stations at multiple dwellings PURPOSE OR GENERAL IDEA OF THE BILL: This legislation does two things: bans the charging of certain lithium- ion batteries in multiple dwellings and requires the installation and maintenance of outdoor lithium-ion battery charging stations at multiple dwellings. CLEARE -- read twice and ordered printed, and when printed to be committed to the Committee on Housing, Construction and Community Development AN ACT to amend the executive law, in relation to requiring the instal- lation and maintenance of outdoor lithium-ion battery charging stations at multiple dwellings THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 20 of section 378 of the executive law, as renumbered by section 3 of part RR of chapter 56 of the laws of 2023, is renumbered subdivision 21 and a new subdivision 20 is added to read as follows: 20. A. STANDARDS (I) REQUIRING THE INSTALLATION AND MAINTENANCE AT ALL MULTIPLE DWELLINGS OF AT LEAST ONE OUTDOOR CHARGING STATION FOR LITHI- UM-ION BATTERIES USED IN POWERED MOBILITY DEVICES BY THE RESIDENTS OF SUCH MULTIPLE DWELLING; AND (II) PROHIBITING CHARGING LITHIUM-ION BATTERIES USED IN POWERED MOBILITY DEVICES INSIDE OF MULTIPLE DWELLINGS. B. AS USED IN THIS SUBDIVISION, THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS: (I) "LITHIUM-ION BATTERY" MEANS A STORAGE BATTERY IN WHICH AN ELEC- TRICAL CURRENT IS GENERATED BY LITHIUM IONS EMBEDDED IN A CARBON GRAPHITE OR NICKEL METAL-OXIDE SUBSTRATE PLACED IN A HIGH-VISCOSITY CARBONATE MIXTURE OR GELLED POLYMER ELECTROLYTE. (II) "POWERED MOBILITY DEVICE" MEANS A BICYCLE WITH ELECTRIC ASSIST AS DEFINED BY SECTION ONE HUNDRED TWO-C OF THE VEHICLE AND TRAFFIC LAW, AN ELECTRIC SCOOTER AS DEFINED BY SECTION ONE HUNDRED FOURTEEN-E OF THE VEHICLE AND TRAFFIC LAW, A LIMITED USE MOTORCYCLE AS DEFINED BY SECTION ONE HUNDRED TWENTY-ONE-B OF THE VEHICLE AND TRAFFIC LAW, WHICH IS POWERED WHOLLY OR PARTIALLY BY AN ELECTRIC MOTOR, AN ELECTRICAL PERSONAL ASSISTIVE MOBILITY DEVICE AS DEFINED IN SECTION ONE HUNDRED FOURTEEN-D OF THE VEHICLE AND TRAFFIC LAW OR OTHER PERSONAL MOBILITY DEVICE EQUIPPED WITH A LITHIUM-ION OR OTHER STORAGE BATTERY, INCLUDING BUT NOT LIMITED TO, A SKATEBOARD, UNICYCLE, OR OTHER SIMILAR WHEELED DEVICE. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
