   printed to be committed to the Committee on Environmental Conservation
 
 AN ACT to amend the  environmental  conservation  law,  in  relation  to
   establishing a symbol to denote environmental composting
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The  environmental  conservation  law  is  amended  by  new
 section 3-0323 to read as follows:
 § 3-0323. COMPOSTING SYMBOL. THE DEPARTMENT SHALL:
   1.  DEVELOP  A  SYMBOL  DENOTING A PRODUCT THAT IS ACCEPTABLE IN EVERY
 COMPOSTING FACILITY GOVERNED BY THE DEPARTMENT;
   2. CREATE A LIST OF CATEGORIES OF PRODUCTS THAT SHALL BEAR THE  SYMBOL
 PURSUANT  TO  SUBDIVISION ONE OF THIS SECTION, INCLUDING BUT NOT LIMITED
 TO SINGLE-USE FOOD CONTAINERS, UTENSILS, AND WRAPPERS,  AND  COMPOSTABLE
 PLASTICS (NOT BIODEGRADABLE, AS DIFFERENTIATED FROM COMPOSTABLE); AND
   3.  PROMULGATE RULES AND REGULATIONS FOR THE IMPLEMENTATION OF, AND TO
 DETERMINE PENALTIES FOR NON-COMPLIANCE WITH THIS SECTION.
   § 2. This act shall take effect immediately.
