TITLE OF BILL:

An act to amend the education law, the state finance law and the tax
law, in relation to requiring the state university of New York and the
city university of New York to provide abortion by medication techniques
at all public colleges and public universities within the state

 
PURPOSE OR GENERAL IDEA OF BILL:

This bill would reduce financial and logistical barriers that public
university students may have to accessing healthcare to safely end a
pregnancy.

 
SUMMARY OF PROVISIONS:

Section 1 amends the education law by adding a new article 129-C enti-
tled "medical and health services" which defines terms, provides that
student health centers at public colleges make abortion medication tech-
niques onsite or contract with a third party to provide services, and

creates a reporting requirement to track outcomes.

Section 2 amends the state finance law by adding a new section 99-qq
that establishes a public colleges and universities student health
center abortion by medication fund under the joint custody of the comp-
troller, commissioner of health, and the SUNY and CUNY chancellors to
which taxpayers may voluntarily contribute. Monies from the fund shall
be made available for payment of any costs associated with the provision
of medication abortion at student health centers.

Section 3 amends the tax law by adding a new section. 630-1 to enable
taxpayers to make a contribution to the public colleges and universities
student health center abortion by medication fund on their personal
income tax return starting beginning in a tax year commencing on or
after January 1 st , 2020. abortion by medication techniques in public

JUSTIFICATION:

College students' often busy schedules, lack of transportation options,
and to -incomes present harriers to accessing abortion healthcare.
Students who want to end a pregnancy have to travel far to off-campus
providers, potentially missing classes and disrupting their studies.

States are increasingly recognizing the provision of medication abortion
on public university campuses as a key way to increase access to
abortion. In 2019, California enacted a law requiring public universi-
ties to offer medication abortion on campus. In 2022, Massachusetts
enacted a similar law. Also in 2022, the private New York City-based
college, Barnard announced its intention to provide medication abortion
at student health center.

For decades, medication abortion has provided a safe, non-invasive, and
effective way to end a pregnancy. According to Planned Parenthood, the
medication has a less than 1% rate of complication and a near 100%
percent rate of effectively terminating pregnancy, making it one of the
safest and most effective medications.

Medication abortion is different than the "morning after pill," which is
typically already available at public university student health centers.
While the morning after pill is intended to prevent pregnancy from
occurring, medication abortion is intended to prevent an existing preg-
nancy from progressing.

According to the most recent data available from the Guttmadher insti-
tute, 39% of counties in New York State are without a known clinic,
presenting obstacles to New Yorkers, including students, who need
abortion care. New York has positioned itself as a safe haven state,
which means people seeking reproductive healthcare will travel to New
York to seek care in addition to New York residents seeking care, creat-
ing more demand on our healthcare systems. As a result, New York must
expand its ability to meet demand. By providing access to medication
abortion at public university student health centers, students will have
access to care in a safe and timely way so they can remain healthy and
focused on their studies.

 AN ACT to amend the education law, the state finance  law  and  the  tax
   law, in relation to requiring the state university of New York and the
   city  university  of  New York to provide abortion by medication tech-
   niques at all public colleges and public universities within the state
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. The education law is amended by adding a new article 129-C
 to read as follows:
                               ARTICLE 129-C
                        MEDICAL AND HEALTH SERVICES
 SECTION 6450. ACCESS TO ABORTION BY MEDICATION TECHNIQUES.
   § 6450. ACCESS TO ABORTION BY MEDICATION TECHNIQUES. 1.  FOR  PURPOSES
 OF THIS SECTION, THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS:
   A.  "STUDENT  HEALTH  CENTER"  SHALL  MEAN  A CLINIC PROVIDING PRIMARY
 HEALTH CARE SERVICES TO STUDENTS.
   B. "ABORTION BY MEDICATION" SHALL MEAN THE PROCESS OF USING MEDICATION
 TO TERMINATE A PREGNANCY.
   C. "PUBLIC COLLEGE" OR "PUBLIC UNIVERSITY" SHALL  MEAN  ANY  COMMUNITY
 COLLEGE,  COLLEGE  OR UNIVERSITY WITHIN THE STATE UNIVERSITY OF NEW YORK
 SYSTEM OR THE CITY UNIVERSITY OF NEW YORK SYSTEM.
   2. (A) EACH PUBLIC COLLEGE OR PUBLIC UNIVERSITY STUDENT HEALTH  CENTER
 SHALL  MAKE  AVAILABLE TO ALL STUDENTS ABORTION BY MEDICATION TECHNIQUES
 ONSITE. THIS SERVICE SHALL BE PROVIDED BY MEDICAL PROFESSIONALS ON STAFF
 AT SUCH STUDENT HEALTH CENTERS OR BY A THIRD PARTY  WHO  HAS  CONTRACTED
 WITH  A  PUBLIC  COLLEGE  OR  PUBLIC  UNIVERSITY TO PROVIDE SUCH MEDICAL
 SERVICES.
   (B) A PUBLIC COLLEGE OR PUBLIC  UNIVERSITY  THAT  CANNOT  PROVIDE  THE
 SERVICES  REQUIRED  BY  PARAGRAPH  (A)  OF THIS SUBDIVISION ONSITE SHALL
 PROVIDE REFERRALS OR INFORMATION FOR OBTAINING AN ABORTION BY MEDICATION

 TECHNIQUES AT A HOSPITAL, CLINIC OR OTHER FACILITY  THAT  PROVIDES  SUCH
 SERVICES.
   3.  WITHIN  TWO  YEARS  OF  THE EFFECTIVE DATE OF THIS SECTION, AND BY
 DECEMBER THIRTY-FIRST OF EACH YEAR THEREAFTER, THE  CHANCELLORS  OF  THE
 STATE  UNIVERSITY OF NEW YORK (SUNY) AND THE CITY UNIVERSITY OF NEW YORK
 (CUNY) SHALL JOINTLY SUBMIT A REPORT TO THE COMMISSIONER, THE  GOVERNOR,
 THE  SPEAKER  OF  THE ASSEMBLY AND THE TEMPORARY PRESIDENT OF THE SENATE
 THAT INCLUDES, BUT IS NOT LIMITED TO, THE FOLLOWING:
   A. THE TOTAL NUMBER OF PUBLIC COLLEGE  OR  PUBLIC  UNIVERSITY  STUDENT
 HEALTH CENTERS THAT PROVIDE ABORTION BY MEDICATION TECHNIQUES;
   B.  THE  NUMBER  OF  ABORTIONS  BY  MEDICATION TECHNIQUES PERFORMED AT
 PUBLIC COLLEGE OR PUBLIC UNIVERSITY STUDENT  HEALTH  CENTERS,  DISAGGRE-
 GATED, TO THE EXTENT POSSIBLE, BY STUDENT HEALTH CENTER; AND
   C.  THE  TOTAL AMOUNT OF FUNDS RECEIVED AND PROVIDED TO STUDENT HEALTH
 CENTERS AT PUBLIC COLLEGES OR PUBLIC UNIVERSITIES IN THE  PREVIOUS  YEAR
 USED  OR  TO  BE USED IN MAKING ABORTION BY MEDICATION TECHNIQUES AVAIL-
 ABLE, DISAGGREGATED BY STUDENT HEALTH CENTER, TO THE EXTENT POSSIBLE.
   § 2. The state finance law is amended by adding a new section 99-qq to
 read as follows:
   § 99-QQ. PUBLIC COLLEGE AND PUBLIC UNIVERSITY  STUDENT  HEALTH  CENTER
 ABORTION BY MEDICATION FUND. 1. THERE IS HEREBY ESTABLISHED IN THE JOINT
 CUSTODY  OF THE COMPTROLLER, THE COMMISSIONER OF HEALTH AND THE CHANCEL-
 LORS OF THE STATE UNIVERSITY OF NEW YORK (SUNY) AND THE CITY  UNIVERSITY
 OF NEW YORK (CUNY) A SPECIAL FUND TO BE KNOWN AS THE "PUBLIC COLLEGE AND
 PUBLIC UNIVERSITY STUDENT HEALTH CENTER ABORTION BY MEDICATION FUND".
   2. A. SUCH FUND SHALL CONSIST OF ALL REVENUES RECEIVED PURSUANT TO THE
 PROVISIONS OF SECTION SIX HUNDRED THIRTY-L OF THE TAX LAW, AND ALL OTHER
 MONEYS  APPROPRIATED,  CREDITED,  OR  TRANSFERRED THERETO FROM ANY OTHER
 FUND OR SOURCE PURSUANT TO LAW.  NOTHING CONTAINED HEREIN SHALL  PREVENT
 THE  STATE  FROM RECEIVING GRANTS, GIFTS OR BEQUESTS FOR THE PURPOSES OF
 THE FUND AS DEFINED IN THIS SECTION AND DEPOSITING THEM  INTO  THE  FUND
 ACCORDING TO LAW.
   B.  NOTWITHSTANDING  ANY OTHER PROVISIONS OF LAW TO THE CONTRARY, SUCH
 FUND SHALL BE AUTHORIZED  TO  RECEIVE  MONEYS  FROM  NONSTATE  ENTITIES,
 INCLUDING,  BUT  NOT  LIMITED  TO, PRIVATE SECTOR ENTITIES AND LOCAL AND
 FEDERAL GOVERNMENT AGENCIES, SPECIFICALLY TO SUPPORT SUCH FUND.
   3. MONIES WITHIN THE PUBLIC  COLLEGE  AND  PUBLIC  UNIVERSITY  STUDENT
 HEALTH CENTER ABORTION BY MEDICATION FUND SHALL BE MADE AVAILABLE TO THE
 COMMISSIONER OF HEALTH FOR PAYMENT OF ANY AND ALL COSTS AND EXPENDITURES
 INCURRED  IN  PERFORMING  ANY OF THE WORK REQUIRED IN MAKING ABORTION BY
 MEDICATION TECHNIQUES AVAILABLE AT PUBLIC COLLEGE AND PUBLIC  UNIVERSITY
 STUDENT HEALTH CENTERS WITHIN THE STATE.
   4.  SERVICES PERFORMED BY PUBLIC COLLEGE AND PUBLIC UNIVERSITY STUDENT
 HEALTH CENTERS AVAILABLE FOR MONEYS FROM THIS FUND  SHALL  INCLUDE,  BUT
 NOT BE LIMITED TO:
   A.  PURCHASE OF EQUIPMENT USED IN THE PROVISION OF ABORTION BY MEDICA-
 TION TECHNIQUES;
   B. FACILITY AND SECURITY UPGRADES;
   C. COSTS ASSOCIATED WITH ENABLING PUBLIC COLLEGE AND PUBLIC UNIVERSITY
 STUDENT HEALTH CENTERS TO DELIVER TELEHEALTH SERVICES;
   D. COSTS ASSOCIATED WITH STAFF TRAINING;
   E. TELEPHONE SUPPORT SERVICES FOR STUDENTS WHO HAVE OBTAINED  ABORTION
 BY MEDICATION TECHNIQUES;
   F. BILLING SPECIALIST CONSULTATIONS; AND
   G. COLLECTING, COMPILING AND ANALYZING INFORMATION FROM PUBLIC COLLEGE
 AND  PUBLIC  UNIVERSITY  STUDENT  HEALTH  CENTERS  TO MEET THE REPORTING

 REQUIREMENTS PURSUANT TO SUBDIVISION THREE OF SECTION SIXTY-FOUR HUNDRED
 FIFTY OF THE EDUCATION LAW.
   5.  MONIES  SHALL BE PAYABLE FROM THE FUND ON THE AUDIT AND WARRANT OF
 THE COMPTROLLER ON VOUCHERS APPROVED AND CERTIFIED BY  THE  COMMISSIONER
 OF HEALTH.
   6.  AMOUNTS  EXPENDED FOR PUBLIC COLLEGE AND PUBLIC UNIVERSITY STUDENT
 HEALTH CENTERS PURSUANT TO THIS SECTION SHALL NOT AFFECT THE AMOUNT THAT
 WOULD OTHERWISE BE APPROPRIATED FOR PUBLIC COLLEGE AND PUBLIC UNIVERSITY
 STUDENT HEALTH CENTERS UNDER ANY OTHER PROVISION OF LAW.
   § 3. The tax law is amended by adding a new section 630-l to  read  as
 follows:
   § 630-L. GIFT  FOR ABORTION BY MEDICATION TECHNIQUES IN PUBLIC COLLEGE
 AND PUBLIC UNIVERSITY STUDENT HEALTH CENTERS. EFFECTIVE FOR ANY TAX YEAR
 COMMENCING ON OR AFTER JANUARY FIRST, TWO THOUSAND TWENTY-FIVE, AN INDI-
 VIDUAL IN ANY TAXABLE YEAR MAY ELECT TO CONTRIBUTE TO THE PUBLIC COLLEGE
 AND PUBLIC UNIVERSITY STUDENT HEALTH CENTER ABORTION BY MEDICATION FUND.
 SUCH CONTRIBUTION SHALL BE IN ANY WHOLE  DOLLAR  AMOUNT  AND  SHALL  NOT
 REDUCE THE AMOUNT OF STATE TAX OWED BY SUCH INDIVIDUAL. THE COMMISSIONER
 SHALL  INCLUDE  SPACE  ON  THE  PERSONAL  INCOME  TAX RETURN TO ENABLE A
 TAXPAYER TO MAKE SUCH CONTRIBUTION. THE COMMISSIONER SHALL  ALSO  ENSURE
 THAT  A DESCRIPTION OF A STUDENT HEALTH CENTER AND THE ABORTION BY MEDI-
 CATION TECHNIQUES BEING OFFERED BY  SUCH  HEALTH  CENTERS  ARE  INCLUDED
 WITHIN THE TAX FORM PREPARATION INSTRUCTION BOOKLET. NOTWITHSTANDING ANY
 OTHER  PROVISION OF LAW, ALL REVENUES COLLECTED PURSUANT TO THIS SECTION
 SHALL BE CREDITED TO THE PUBLIC COLLEGE AND  PUBLIC  UNIVERSITY  STUDENT
 HEALTH  CENTER  ABORTION  BY  MEDICATION  FUND  AND  USED ONLY FOR THOSE
 PURPOSES ENUMERATED IN SECTION NINETY-NINE-QQ OF THE STATE FINANCE LAW.
   § 4. This act shall take effect immediately.

 UNIVERSITY OF NEW YORK SHALL PROVIDE ACCESS TO  MEDICATION  ABORTION  TO
 ALL STUDENTS ENROLLED AT SUCH INSTITUTIONS BY EITHER:
   (A)  EMPLOYING OR CONTRACTING WITH INDIVIDUALS AUTHORIZED TO PRESCRIBE
 MEDICATION ABORTION PRESCRIPTION DRUGS  WITHIN  THEIR  LAWFUL  SCOPE  OF
 PRACTICE PURSUANT TO TITLE EIGHT OF THIS CHAPTER; OR
   (B) PROVIDING STUDENTS WITH INFORMATION AND REFERRALS TO LOCAL PROVID-
 ERS AUTHORIZED TO PRESCRIBE MEDICATION ABORTION PRESCRIPTION DRUGS WITH-
 IN  THEIR LAWFUL SCOPE OF PRACTICE PURSUANT TO TITLE EIGHT OF THIS CHAP-
 TER.
   § 2. This act shall take effect August 1, 2023. Effective immediately,
 the addition, amendment and/or repeal of any rule or  regulation  neces-
 sary  for  the  implementation  of  this  act  on its effective date are
 authorized to be made and completed on or before such effective date.

TITLE OF BILL:

An act to amend the education law, in relation to providing access to
medication abortion prescription drugs at the state university of New
York and the city university of New York

 
PURPOSE OR GENERAL IDEA OF BILL:

This bill would require SUNY and CUNY to provide access to medication
abortion to all enrolled students.

 
SUMMARY OF PROVISIONS:

Section 1 amends the education law by adding a new section 6438-b to
require every SUNY and CUNY campus to provide access to medication
abortion to all enrolled students.

Section 2 requires SUNY and CUNY submit a report to the Governor and the
legislature on the provision of such access.

Section 3 provides the effective date.

 
JUSTIFICATION:

For decades, medication abortion has provided a safe, non-invasive, and
effective way to end a pregnancy. According to Planned Parenthood, the
medication has a less than 1% rate of complication and a near 100% rate
of effectively terminating pregnancy, making it one of the safest and
most effective medications.

Medication abortion is different than the "morning after pill," which is
typically already available at public university student health centers.
While the morning after pill is intended to prevent pregnancy from
occurring, medication abortion is intended to prevent an existing preg-
nancy from progressing.

This bill would ensure that our public colleges provide students with
access to these medication abortion prescription drugs, either by 1)
employing or contracting with authorized prescribers acting within their
scope of practice, or 2) providing students with information and refer-
rals to authorized prescribers acting within their scope of practice.
Such information and referrals may include local providers and tele-
health providers.

 AN ACT to amend the education law, in relation to  providing  access  to
   medication  abortion prescription drugs at the state university of New
   York and the city university of New York
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The education law is amended by adding a new section 6438-b
 to read as follows:
   §  6438-B.  ACCESS TO MEDICATION ABORTION PRESCRIPTION DRUGS. 1. EVERY
 CAMPUS OF THE STATE UNIVERSITY OF NEW YORK AND EVERY CAMPUS OF THE  CITY
 UNIVERSITY  OF  NEW  YORK SHALL PROVIDE ACCESS TO MEDICATION ABORTION TO
 ALL STUDENTS ENROLLED AT SUCH INSTITUTIONS BY EITHER:
   (A) EMPLOYING OR CONTRACTING WITH INDIVIDUALS AUTHORIZED TO  PRESCRIBE
 MEDICATION  ABORTION  PRESCRIPTION  DRUGS  WITHIN  THEIR LAWFUL SCOPE OF
 PRACTICE PURSUANT TO TITLE EIGHT OF THIS CHAPTER; OR
   (B) PROVIDING STUDENTS WITH INFORMATION  AND  REFERRALS  TO  PROVIDERS
 AUTHORIZED  TO  PRESCRIBE  MEDICATION ABORTION PRESCRIPTION DRUGS WITHIN
 THEIR LAWFUL SCOPE OF PRACTICE PURSUANT TO TITLE EIGHT OF THIS CHAPTER.
   2. TWENTY-FOUR MONTHS AFTER THE EFFECTIVE DATE OF  THIS  SECTION,  AND
 ANNUALLY  ON  SUCH  DATE  THEREAFTER, THE BOARD OF TRUSTEES OF THE STATE
 UNIVERSITY OF NEW YORK AND THE BOARD OF TRUSTEES OF THE CITY  UNIVERSITY
 OF  NEW  YORK  SHALL EACH SUBMIT A REPORT TO THE GOVERNOR, THE TEMPORARY
 PRESIDENT OF THE SENATE AND THE SPEAKER OF THE ASSEMBLY  THAT  INCLUDES,
 BUT IS NOT LIMITED TO, THE FOLLOWING:
   (A) WHETHER CAMPUSES PROVIDE ACCESS TO MEDICATION ABORTION PURSUANT TO
 PARAGRAPH (A) OR PARAGRAPH (B) OF SUBDIVISION ONE OF THIS SECTION; AND
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

   (B)  THE  NUMBER OF INDIVIDUALS AT EACH CAMPUS AUTHORIZED TO PRESCRIBE
 SUCH PRESCRIPTION DRUGS.
   § 2. This act shall take effect August 1, 2023. Effective immediately,
 the  addition,  amendment and/or repeal of any rule or regulation neces-
 sary for the implementation of  this  act  on  its  effective  date  are
 authorized to be made and completed on or before such effective date.
