BILL NUMBER: S2442 SPONSOR: HOYLMAN-SIGAL TITLE OF BILL: An act to amend the executive law, in relation to the definition of "sexual orientation" as applicable to the human rights law PURPOSE: To remove outdated and stigmatizing statutory language from the defi- nition of "sexual orientation" in New York's Human Rights Law. SUMMARY OF PROVISIONS: Section 1 of the bill amends Subdivision 27 of Section 292 of the Execu- tive Law by striking the phrase "However, nothing contained herein shall be construed to protect conduct otherwise proscribed by law" from the definition of "sexual orientation." Section 2 of the bill is the effective date.

HOYLMAN-SIGAL, SALAZAR -- read twice and ordered printed, and when printed to be committed to the Committee on Investi- gations and Government Operations AN ACT to amend the executive law, in relation to the definition of "sexual orientation" as applicable to the human rights law THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 27 of section 292 of the executive law, as added by chapter 2 of the laws of 2002, is amended to read as follows: 27. The term "sexual orientation" means heterosexuality, homosexuali- ty, bisexuality or asexuality, whether actual or perceived. [However, nothing contained herein shall be construed to protect conduct otherwise proscribed by law.] § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD02137-01-3
