TITLE OF BILL:

An act to amend the public health law, in relation to enacting the safer
consumption services act

 
PURPOSE:

This bill relates to the enactment of the Safer Consumption Services Act
to authorize and regulate Overdose Prevention Centers in New York State.

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1 amends Public Health law to add a new Article 33-C known as
the Safe Consumption Services Act, creating sections 3399 a-e of the
Public Health law.

Section 3399a creates definitions for "program" as an overdose
prevention center instead of safer consumption services. This section
also defines "Entity" and "Participants," as it relates to the

provisions of Article 33-C.

Section 3399-b establishes the approval process for overdose prevention
centers which includes timelines for approval and minimum requirements
for the Department of Health to regulate.

Section 3399-C mandates reporting requirements for overdose prevention
centers that includes the number of participants, syringe uses, experi-
enced and intervened overdoses, referrals to other services, and charac-
teristic information.

Section 3399-e establishes the immunity protections for participants,
staff, and property owners.

Section 2 of this bill sets the effective date.

 
JUSTIFICATION:

New York and the rest of the country are now over five years into an
opioid public health emergency, first declared in October 2017 by the
federal government. This year, the federal government issued a new
comprehensive strategy to address drug overdoses, and New York and other
states are receiving new resources from settlements with opioid manufac-
turers, distributors and others that provide an opportunity to bolster
efforts to prevent abuse, support treatment and reduce harm in order to
prevent as many drug overdose deaths as possible. Due to fentanyl's
increased presence in the drug supply, OASAS also consideri harm
reduction strategies as "imperative" to reducing the risk of overdose
for people using "essentially anything purchased illicitly." According
to OASAS, harm reduction strategies include: access to and disposal of
sterile syringes and injection equipment; access to fentanyl test
strips; overdose prevention centers; and increased availability of
naloxone and overdose prevention education and training.

Since the opening of the two overdose prevention centers (OPCs) run by
OnPoint NYC on November 30, 2021, these facilities have been an essen-
tial tool for reducing overdose deaths in New York City (NYC).  As of
December 2022, there have been over 2,000 participants, 600 overdose
interventions, and 50,000 utilizations. The centers are collocated with
Syringe Exchange Programs (SEPs) which provide harm reduction services
for people with substance abuse disorder. The services provided in this
setting include health screenings, testing the substance for safety of
use, and monitoring by staff trained at the nurse level. The SEPs offer
a supplemental number of services that provides a general safe space for
people who use drugs and are commonly experiencing homelessness that
includes laundry service, a place to sleep, food, and holistic services
among the many other harm reduction services offered.

A study by the Injection Drug Users Health Alliance (IDUHA) found that
46% of intravenous drug users inject in public places such as parks or
subways and 60% of users inject in public places such as public bath-
rooms. Improperly discarded syringes can pose health risks and opioid
use is correlated with higher rates of HIV/AIDS, Hepatitis C, as well as
negative public health outcomes. OPCs address many of these neighborhood
issues through syringe cleanup, mobile testing, and community outreach
while helping individuals who utilize services inside the facility.

This bill will reduce overdose deaths associated with opioid use and the
dangers to the public caused by public drug use by allowing the New York
State Department of Health to authorize and regulate OPCs for spaces
where individuals can use pre-obtained drugs under the supervision of
medical professionals. Staff members of these programs will provide
sterile injection supplies, collect used hypodermic needles and syring-
es, and teach patients about safe consumption practices. Participants
will also be able to access referrals to addiction treatment, job train-
ing, and other social services. This bill would allow state funds to be
used to fund OPCs and would grant protections from criminal prosecution
for people who decide to participate in these programs. Currently, OPCs
are only funded through private donations. It is estimated that the NYC
OPCs cost around $3 million annually to operate and the two current NYC
OPCs have save the state an average of $19 million annually by reducing
overdoses and reducing ambulance and hospital services as it relates to
overdose interventions and substance use disorder including hazardous
waste collection averting costs to the neighborhoods being served.

There are approximately 100 similar programs operating in at least 66
cities in nine countries, including Germany, Spain, Portugal, and Cana-
da. Seattle is in the process of establishing a safer consumption
program, and other states, including Maine, Rhode Island, and Maryland,
have introduced similar legislation. The first and only safer consump-
tion program in North America opened in Vancouver in 2003. Since then,
the program has had roughly 3.6 million visitors and staff members have
intervened in over 6,000 overdoses and no one has died at the facility.

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The  public health law is amended by adding a new article
 33-C to read as follows:
                               ARTICLE 33-C
                      SAFER CONSUMPTION SERVICES ACT
 SECTION 3399.   SHORT TITLE.
         3399-A. DEFINITIONS.

         3399-E. IMMUNITY PROVIDED.
   § 3399. SHORT TITLE. THIS ACT SHALL BE KNOWN AND MAY BE CITED  AS  THE
 "SAFER CONSUMPTION SERVICES ACT".
   § 3399-A. DEFINITIONS. AS USED IN THIS ARTICLE:
   1.  "PROGRAM"  MEANS AN OVERDOSE PREVENTION CENTER PROGRAM ESTABLISHED
 PURSUANT TO THIS ARTICLE.
   2. "ENTITY" MEANS ANY COMMUNITY-BASED ORGANIZATION THAT IS AN  AUTHOR-
 IZED  SYRINGE EXCHANGE PROGRAM IN ACCORDANCE WITH THE REGULATIONS OF THE
 DEPARTMENT WHICH PROVIDES EDUCATIONAL, HEALTH, HARM REDUCTION,  HOUSING,
 OR  SOCIAL  SERVICES  AND ANY HOSPITAL, MEDICAL CLINIC OR OFFICE, HEALTH
 CENTER, NURSING CARE FACILITY, MENTAL HEALTH FACILITY, OR OTHER  SIMILAR
 ENTITY THAT PROVIDES MEDICAL CARE.

   3.  "PARTICIPANT"  MEANS AN INDIVIDUAL WHO SEEKS TO UTILIZE, UTILIZES,
 OR HAS USED A PROGRAM ESTABLISHED PURSUANT TO THIS ARTICLE.
   §  3399-B. PROGRAM APPROVAL. 1. NOTWITHSTANDING ANY OTHER STATUTE, LAW
 OR RULE TO THE CONTRARY, THE DEPARTMENT MAY APPROVE AN ENTITY TO OPERATE
 A PROGRAM IN ONE OR MORE JURISDICTIONS UPON SATISFACTION OF THE REQUIRE-
 MENTS SET FORTH IN SUBDIVISION TWO OF THIS SECTION. THE DEPARTMENT SHALL
 ESTABLISH STANDARDS FOR PROGRAM APPROVAL AND TRAINING AND MAY PROMULGATE
 SUCH RULES AND REGULATIONS AS ARE NECESSARY TO IMPLEMENT THIS SECTION.
   (A) THE DEPARTMENT SHALL APPROVE OR DENY  AN  APPLICATION  UNDER  THIS
 SECTION  WITHIN FORTY-FIVE DAYS OF THE DAY OF RECEIPT OF THE APPLICATION
 AND PROVIDE A WRITTEN EXPLANATION OF SUCH DETERMINATION.
   (B) AN ENTITY MAY MAKE AN APPLICATION UNDER THIS SECTION AT ANY  TIME,
 REGARDLESS OF PREVIOUS APPLICATIONS.
   2.  THE DEPARTMENT MAY APPROVE AN ENTITY TO OPERATE A PROGRAM PURSUANT
 TO THIS ARTICLE, UPON SUBMISSION OF AN APPLICATION THAT DEMONSTRATES THE
 ENTITY WILL, AT A MINIMUM:
   (A) PROVIDE A HYGIENIC SPACE  WHERE  PARTICIPANTS  MAY  CONSUME  THEIR
 PREOBTAINED  DRUGS THAT IS SEPARATE FROM THE SPACE IN WHICH THE PROVIDER
 PERFORMS OTHER SERVICES;
   (B) PROVIDE ADEQUATE STAFFING BY  HEALTHCARE  PROFESSIONALS  OR  OTHER
 TRAINED STAFF;
   (C)  PROVIDE STERILE INJECTION AND OTHER CONSUMPTION SUPPLIES, COLLECT
 USED HYPODERMIC NEEDLES AND  SYRINGES,  AND  PROVIDE  SECURE  HYPODERMIC
 NEEDLE AND SYRINGE DISPOSAL SERVICES;
   (D)  PROVIDE EDUCATION ON SAFER CONSUMPTION PRACTICES, PROPER DISPOSAL
 OF HYPODERMIC NEEDLES AND SYRINGES, AND OVERDOSE  PREVENTION,  INCLUDING
 WRITTEN  INFORMATION  IN,  AT  A  MINIMUM, THE FOUR MOST COMMONLY SPOKEN
 LANGUAGES IN THE STATE AS DETERMINED BY THE DEPARTMENT;
   (E) ADMINISTER FIRST AID, IF  NEEDED,  AND  MONITOR  PARTICIPANTS  FOR
 POTENTIAL OVERDOSE;
   (F)  PROVIDE  REFERRALS  TO SUBSTANCE USE DISORDER TREATMENT, MEDICAL,
 SOCIAL WELFARE, AND EMPLOYMENT AND TRAINING SERVICES;
   (G) EDUCATE PARTICIPANTS ON THE RISKS OF  CONTRACTING  HIV  AND  VIRAL
 HEPATITIS  AND  PROVIDE SEXUAL HEALTH RESOURCES AND SUPPLIES, INCLUDING,
 BUT NOT LIMITED TO, MALE AND FEMALE CONDOMS;
   (H) PROVIDE ACCESS TO NALOXONE OR REFERRALS  TO  OBTAIN  NALOXONE  FOR
 PARTICIPANTS;
   (I)  PROVIDE  REASONABLE AND ADEQUATE SECURITY OF THE PROGRAM SITE AND
 EQUIPMENT;
   (J) ENSURE CONFIDENTIALITY OF PROGRAM PARTICIPANTS BY USING AN  ANONY-
 MOUS UNIQUE IDENTIFIER;
   (K)  TRAIN STAFF MEMBERS TO DELIVER SERVICES OFFERED BY THE PROGRAM OR
 ATTEND TRAININGS PROVIDED BY THE DEPARTMENT; AND
   (L) ESTABLISH OPERATING PROCEDURES FOR THE PROGRAM AS WELL  AS  ELIGI-
 BILITY CRITERIA FOR PROGRAM PARTICIPANTS.
   §  3399-C.  DESIGNATION.  A  DEPARTMENT APPROVED PROGRAM SHALL ALSO BE
 DESIGNATED AS AN AUTHORIZED SYRINGE EXCHANGE PROGRAM IN ACCORDANCE  WITH
 THE REGULATIONS OF THE DEPARTMENT AS SET FORTH IN 10 NYCRR 80.135 AND AS
 A  REGISTERED  PROVIDER  OF  AN  OPIOID  OVERDOSE  PREVENTION PROGRAM IN
 ACCORDANCE WITH THE REGULATIONS OF THE DEPARTMENT AS  SET  FORTH  IN  10
 NYCRR 80.138.
   § 3399-D. REPORTING. AN ENTITY OPERATING AN OVERDOSE PREVENTION CENTER
 UNDER THIS ARTICLE SHALL PROVIDE AN ANNUAL REPORT TO THE DEPARTMENT AT A
 DATE SET BY THE DEPARTMENT THAT SHALL INCLUDE:
   1. THE NUMBER OF PROGRAM PARTICIPANTS;

   2.  AGGREGATE  INFORMATION  REGARDING  THE  CHARACTERISTICS OF PROGRAM
 PARTICIPANTS;
   3.  THE  NUMBER OF HYPODERMIC NEEDLES AND SYRINGES DISTRIBUTED FOR USE
 ON-SITE;
   4. THE NUMBER OF OVERDOSES EXPERIENCED, THE NUMBER OF OVERDOSES INTER-
 VENED ON-SITE, AND THE OUTCOMES; AND
   5. THE NUMBER OF INDIVIDUALS DIRECTLY AND FORMALLY REFERRED  TO  OTHER
 SERVICES AND THE TYPE OF SERVICE.
   § 3399-E. IMMUNITY PROVIDED. NOTWITHSTANDING ANY OTHER STATUTE, LAW OR
 RULE  TO  THE  CONTRARY,  THE  FOLLOWING  PERSONS SHALL NOT BE ARRESTED,
 CHARGED, OR PROSECUTED FOR ANY CRIMINAL OFFENSE OR  BE  SUBJECT  TO  ANY
 CIVIL  OR  ADMINISTRATIVE  PENALTY,  INCLUDING  SEIZURE OR FORFEITURE OF
 ASSETS OR REAL PROPERTY OR DISCIPLINARY ACTION BY A PROFESSIONAL LICENS-
 ING BOARD, OR BE DENIED ANY RIGHT OR PRIVILEGE, SOLELY FOR PARTICIPATION
 OR INVOLVEMENT IN AN OVERDOSE PREVENTION CENTER APPROVED BY THE  DEPART-
 MENT  SO LONG AS SUCH PARTICIPATION OR INVOLVEMENT WAS IN GOOD FAITH AND
 IN ACCORDANCE WITH ESTABLISHED PROTOCOLS PURSUANT TO THIS ARTICLE:
   1. A PARTICIPANT;
   2. A STAFF MEMBER OR ADMINISTRATOR OF A PROGRAM, INCLUDING  A  HEALTH-
 CARE  PROFESSIONAL, MANAGER, EMPLOYEE, BOARD MEMBER, DIRECTOR, OR VOLUN-
 TEER; OR
   3. A PROPERTY OWNER WHO OWNS PROPERTY AT WHICH A  PROGRAM  IS  LOCATED

PURPOSE:

This bill relates to the enactment of the Safer Consumption Services
Act.   
SUMMARY OF SPECIFIC PROVISIONS:

Section 1 amends Section 3399 subdivisions a-f of the Public Health law.
Subdivision a is amended by defining "program" as an overdose prevention
center instead of safer consumption services. "Entity" is also redefined
as a community based organization that is that is an authorized syringe
exchange program in accordance with the regulations of the department
which provides educational, health, harm reduction, housing, or social
services and any hospital, medical clinic or office, health center,
nursing care facility, mental health facility, or other similar entity
that provides medical care. It rephrases "addiction" to "substance abuse

disorder". Language to ensure protections from criminal charges and
immunity for participating in an overdose prevention center was also
amended in the bill.

Section 2 reflects the effective date.

 
JUSTIFICATION:

Overdose prevention center (OPC) has been an essential tool for reducing
the risk of an overdose or other harmful effects associated with
substance abuse disorder. OPC's are more than a safe place for people to
use. Many of them offer a number of services such as health screenings,
a place to sleep, testing the safety of whichever substance a person is
planning on using. With the number of services offered, OPC's provide a
general safe space for people. Therefore, it is important to have
protections, from criminal prosecution, in place for people who decide
to participate in these programs.

 PREOBTAINED DRUGS THAT IS SEPARATE FROM THE SPACE IN WHICH THE  PROVIDER
 PERFORMS OTHER SERVICES;
   (B)  PROVIDE  ADEQUATE  STAFFING  BY HEALTHCARE PROFESSIONALS OR OTHER
 TRAINED STAFF;
   (C) PROVIDE STERILE INJECTION AND OTHER CONSUMPTION SUPPLIES,  COLLECT
 USED  HYPODERMIC  NEEDLES  AND  SYRINGES,  AND PROVIDE SECURE HYPODERMIC
 NEEDLE AND SYRINGE DISPOSAL SERVICES;
   (D) PROVIDE EDUCATION ON SAFER CONSUMPTION PRACTICES, PROPER  DISPOSAL
 OF  HYPODERMIC  NEEDLES AND SYRINGES, AND OVERDOSE PREVENTION, INCLUDING
 WRITTEN INFORMATION IN, AT A MINIMUM,  THE  FOUR  MOST  COMMONLY  SPOKEN
 LANGUAGES IN THE STATE AS DETERMINED BY THE DEPARTMENT;
   (E)  ADMINISTER  FIRST  AID,  IF  NEEDED, AND MONITOR PARTICIPANTS FOR
 POTENTIAL OVERDOSE;
   (F) PROVIDE REFERRALS TO SUBSTANCE USE  DISORDER  TREATMENT,  MEDICAL,
 SOCIAL WELFARE, AND EMPLOYMENT AND TRAINING SERVICES;
   (G)  EDUCATE  PARTICIPANTS  ON  THE RISKS OF CONTRACTING HIV AND VIRAL
 HEPATITIS AND PROVIDE SEXUAL HEALTH RESOURCES AND  SUPPLIES,  INCLUDING,
 BUT NOT LIMITED TO, MALE AND FEMALE CONDOMS;
   (H)  PROVIDE  ACCESS  TO  NALOXONE OR REFERRALS TO OBTAIN NALOXONE FOR
 PARTICIPANTS;
   (I) PROVIDE REASONABLE AND ADEQUATE SECURITY OF THE PROGRAM  SITE  AND
 EQUIPMENT;
   (J)  ENSURE CONFIDENTIALITY OF PROGRAM PARTICIPANTS BY USING AN ANONY-
 MOUS UNIQUE IDENTIFIER;
   (K) TRAIN STAFF MEMBERS TO DELIVER SERVICES OFFERED BY THE PROGRAM  OR
 ATTEND TRAININGS PROVIDED BY THE DEPARTMENT; AND
   (L)  ESTABLISH  OPERATING PROCEDURES FOR THE PROGRAM AS WELL AS ELIGI-
 BILITY CRITERIA FOR PROGRAM PARTICIPANTS.
   § 3399-C. DESIGNATION. A DEPARTMENT APPROVED  PROGRAM  SHALL  ALSO  BE
 DESIGNATED  AS AN AUTHORIZED SYRINGE EXCHANGE PROGRAM IN ACCORDANCE WITH
 THE REGULATIONS OF THE DEPARTMENT AS SET FORTH IN 10 NYCRR 80.135 AND AS
 A REGISTERED PROVIDER  OF  AN  OPIOID  OVERDOSE  PREVENTION  PROGRAM  IN
 ACCORDANCE  WITH  THE  REGULATIONS  OF THE DEPARTMENT AS SET FORTH IN 10
 NYCRR 80.138.
   § 3399-D. REPORTING. AN ENTITY OPERATING AN OVERDOSE PREVENTION CENTER
 PROGRAM UNDER THIS ARTICLE SHALL PROVIDE AN ANNUAL REPORT TO THE DEPART-
 MENT AT A DATE SET BY THE DEPARTMENT THAT SHALL INCLUDE:

   1. THE NUMBER OF PROGRAM PARTICIPANTS;
   2.  AGGREGATE  INFORMATION  REGARDING  THE  CHARACTERISTICS OF PROGRAM
 PARTICIPANTS;
   3. THE NUMBER OF HYPODERMIC NEEDLES AND SYRINGES DISTRIBUTED  FOR  USE
 ON-SITE;
   4. THE NUMBER OF OVERDOSES EXPERIENCED, THE NUMBER OF OVERDOSES INTER-
 VENED ON-SITE, AND THE OUTCOMES; AND
   5.  THE  NUMBER OF INDIVIDUALS DIRECTLY AND FORMALLY REFERRED TO OTHER
 SERVICES AND THE TYPE OF SERVICE.
   § 3399-E. IMMUNITY PROVIDED. NOTWITHSTANDING ANY OTHER STATUTE, LAW OR
 RULE TO THE CONTRARY, THE  FOLLOWING  PERSONS  SHALL  NOT  BE  ARRESTED,
 CHARGED,  OR  PROSECUTED  FOR  ANY CRIMINAL OFFENSE OR BE SUBJECT TO ANY
 CIVIL OR ADMINISTRATIVE PENALTY,  INCLUDING  SEIZURE  OR  FORFEITURE  OF
 ASSETS OR REAL PROPERTY OR DISCIPLINARY ACTION BY A PROFESSIONAL LICENS-
 ING BOARD, OR BE DENIED ANY RIGHT OR PRIVILEGE, SOLELY FOR PARTICIPATION
 OR  INVOLVEMENT IN AN OVERDOSE PREVENTION CENTER PROGRAM APPROVED BY THE
 DEPARTMENT SO LONG AS SUCH PARTICIPATION  OR  INVOLVEMENT  WAS  IN  GOOD
 FAITH  AND  IN  ACCORDANCE  WITH  ESTABLISHED PROTOCOLS PURSUANT TO THIS
 ARTICLE:
   1. A PARTICIPANT;
   2. A STAFF MEMBER OR ADMINISTRATOR OF A PROGRAM, INCLUDING  A  HEALTH-
 CARE  PROFESSIONAL, MANAGER, EMPLOYEE, BOARD MEMBER, DIRECTOR, OR VOLUN-
 TEER; OR
   3. A PROPERTY OWNER WHO OWNS PROPERTY AT WHICH A  PROGRAM  IS  LOCATED
 AND OPERATES.
   § 2. This act shall take effect immediately.
