BILL NUMBER: S5537 SPONSOR: MAY TITLE OF BILL: An act to amend the election law, in relation to authorizing county boards of elections to establish county-wide polling places PURPOSE: To provide counties, at their discretion, to establish at least one county-wide polling place on Election Day SUMMARY OF SPECIFIC PROVISIONS: Amends the election law to give county boards of elections the option to establish vote centers, where any person entitled to vote in such county can do so on election day. MAY -- read twice and ordered printed, and when printed to be committed to the Committee on Elections AN ACT to amend the election law, in relation to authorizing county boards of elections to establish county-wide polling places THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The election law is amended by adding a new section 8-110 to read as follows: § 8-110. COUNTY-WIDE POLLING PLACES. 1. A COUNTY BOARD OF ELECTIONS MAY ESTABLISH ONE OR MORE POLLING PLACES IN THE COUNTY WHERE ANY PERSON ENTITLED TO VOTE IN SUCH COUNTY BY PERSONAL APPEARANCE MAY SO VOTE ON THE DAY OF A PRIMARY ELECTION OR GENERAL ELECTION. 2. ANY PERSON ENTITLED TO VOTE IN A COUNTY BY PERSONAL APPEARANCE MAY DO SO AT ANY POLLING PLACE ESTABLISHED IN SUCH COUNTY PURSUANT TO SUBDI- VISION ONE OF THIS SECTION. 3. NO COUNTY-WIDE POLLING PLACE ESTABLISHED UNDER SUBDIVISION ONE OF THIS SECTION SHALL REPLACE OR OTHERWISE DECREASE THE NUMBER OF POLLING PLACES OTHERWISE REQUIRED UNDER LAW. ANY SUCH COUNTY-WIDE POLLING PLACE SHALL BE SUBJECT TO ALL OTHER VOTING AND POLLING PLACE REQUIREMENTS UNDER THIS ARTICLE NOT OTHERWISE INCONSISTENT WITH THE PROVISIONS OF THIS SECTION. § 2. The A-print of this bill makes technical changes, adds a requirement to file a plan with the state board of elections, and gives the state board rulemaking authority for the establishment of vote centers.

FOR THE PURPOSES OF THIS SECTION, THE TERM "COUNTY-WIDE POLLING PLACE" SHALL MEAN A POLLING PLACE IN A COUNTY WHERE ANY PERSON ENTITLED TO VOTE IN SUCH COUNTY BY PERSONAL APPEARANCE MAY SO VOTE ON THE DAY OF A PRIMARY ELECTION OR GENERAL ELECTION. 2. A COUNTY BOARD OF ELECTIONS MAY ESTABLISH ONE OR MORE COUNTY-WIDE POLLING PLACES IN ITS COUNTY, UPON APPROVAL BY THE STATE BOARD OF ELECTIONS PURSUANT TO SUBDIVISION FIVE OF THIS SECTION. 3. ANY PERSON ENTITLED TO VOTE IN A COUNTY BY PERSONAL APPEARANCE MAY DO SO AT ANY COUNTY-WIDE POLLING PLACE ESTABLISHED IN SUCH COUNTY PURSU- ANT TO SUBDIVISION TWO OF THIS SECTION. 4. ANY SUCH COUNTY-WIDE POLLING PLACE SHALL BE SUBJECT TO ALL OTHER VOTING AND POLLING PLACE REQUIREMENTS UNDER THIS ARTICLE NOT OTHERWISE INCONSISTENT WITH THE PROVISIONS OF THIS SECTION. 5. NO COUNTY BOARD OF ELECTIONS SHALL ESTABLISH A COUNTY-WIDE POLLING PLACE PURSUANT TO THIS SECTION WITHOUT FIRST OBTAINING APPROVAL FROM THE STATE BOARD OF ELECTIONS. A COUNTY BOARD OF ELECTIONS MAY SEEK SUCH APPROVAL BY SUBMITTING ITS PLANS FOR THE ESTABLISHMENT AND IMPLEMENTA- TION OF SUCH COUNTY-WIDE POLLING PLACE TO THE STATE BOARD OF ELECTIONS NO LATER THAN NINETY DAYS BEFORE THE DATE OF THE NEXT ELECTION.
