BILL NUMBER: S5815 SPONSOR: MANNION TITLE OF BILL: An act to amend the public health law, in relation to education and outreach programs on the dangers of fatal and non-fatal drowning PURPOSE OF BILL: The purpose of this bill is to create a public education campaign to inform the public about the dangers of fatal and non-fatal drowning. SUMMARY OF PROVISIONS: Section 1 of this bill would require that the Commissioner of Health promote public awareness of the dangers of fatal and non-fatal drowning, including but not limited to the unique risk factors and exposures asso- ciated with infant and early childhood drowning, childhood and teenage drowning, adult drowning, and the disparate risk of drowning on under- served communities and individuals with developmental disabilities, and methods to reduce the risks of drowning including water safety instruc-

MANNION -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to education and outreach programs on the dangers of fatal and non-fatal drowning THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 207 of the public health law is amended by adding a new paragraph (r) to read as follows: (R) PROMOTING PUBLIC AWARENESS OF THE DANGERS OF FATAL AND NON-FATAL DROWNING, INCLUDING BUT NOT LIMITED TO THE UNIQUE RISK FACTORS AND EXPO- SURES ASSOCIATED WITH INFANT AND EARLY DROWNING, CHILDHOOD AND TEENAGE DROWNING AND ADULT DROWNING, THE DISPARATE RISK OF DROWNING IN DISADVAN- TAGED COMMUNITIES IDENTIFIED PURSUANT TO SECTION 75-0111 OF THE ENVIRON- MENTAL CONSERVATION LAW AND WITH INDIVIDUALS WITH A MENTAL DISABILITY AS DEFINED BY SUBDIVISION THREE OF SECTION 1.03 OF THE MENTAL HYGIENE LAW, AND METHODS TO REDUCE THE RISKS OF DROWNING, INCLUDING BUT NOT LIMITED TO WATER SAFETY INSTRUCTION, SWIM LESSONS, AND AWARENESS OF WATER BASED RISKS. § 2. This act shall take effect June 1, 2024. Effective immediately, the addition, amendment, and/or repeal of any rule or regulation neces- sary for the implementation of this act on its effective date are authorized to be made and completed on or before such effective date.
