BILL NUMBER: S6062 SPONSOR: HARCKHAM PURPOSE: Waives the residency requirement for the commissioner of planning, development, and public transportation for Putnam county SUMMARY OF PROVISIONS: Section 1 amends section 3 of public officers law to exempt the county of Putnam from the requirement mandating the commissioner of planning, development, and public transportation to reside in Putnam County. Section 2 states the effective date. JUSTIFICATION: The Putnam Commissioner of Planning, Development, and Public Transporta- tion plays an essential role in driving economic growth by directing millions of dollars into the local economy-indirectly touching the lives of all residents of the county. HARCKHAM -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the public officers law, in relation to waiving the residency requirement for the commissioner of planning, development, and public transportation for Putnam county THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3 of the public officers law is amended by adding a new subdivision 73 to read as follows: 73. IN THE COUNTY OF PUTNAM, THE PROVISIONS OF THIS SECTION REQUIRING A PERSON TO BE A RESIDENT OF THE POLITICAL SUBDIVISION OR MUNICIPAL CORPORATION OF THE STATE FOR WHICH HE OR SHE SHALL BE CHOSEN OR WITHIN WHICH HIS OR HER OFFICIAL FUNCTIONS ARE REQUIRED TO BE EXERCISED, SHALL NOT PREVENT A PERSON FROM HOLDING THE OFFICE OF COMMISSIONER OF PLAN- NING, DEVELOPMENT, AND PUBLIC TRANSPORTATION OF THE COUNTY OF PUTNAM, PROVIDED THAT SUCH PERSON RESIDES IN PUTNAM COUNTY OR AN ADJOINING COUN- TY WITHIN THE STATE OF NEW YORK; PROVIDED, HOWEVER THAT ANY PERSON PERFORMING SUCH FUNCTIONS OR HOLDING THE OFFICE OF COMMISSIONER OF PLAN- NING, DEVELOPMENT, AND PUBLIC TRANSPORTATION IN ANY OTHER COUNTY SHALL BE A RESIDENT OF SUCH COUNTY UNLESS OTHERWISE PROVIDED BY LAW. § 2.
