TITLE OF BILL:

An act to amend the environmental conservation law, in relation to big
game hunting authorization for the county of Onondaga; and providing for
the repeal of such provisions upon expiration thereof

 
PURPOSE OF BILL:

The purpose of this bill is to allow the hunting of big game through the
use of a rifle in Onondaga County.

 
SUMMARY OF PROVISIONS:

Section 1 of this bill would amend Paragraph a of subdivision 2 of
section 11-0907 of the Environmental Conservation Law by adding a new
item (o) to allow rifle hunting of big game in Onondaga County from the
first Saturday after November 15 through the first Sunday after December
7.

Section 2 of this bill would amend Item (f) of paragraph a of subdivi-
sion 2 of section 11-0907 of the Environmental Conservation Law to
include a new item (o) to allow rifle hunting of big game in Onondaga
County from the first Monday after November 15 through the first Tuesday
after December 7.

Section 3 of this bill would amend Paragraph a of subdivision 2 of
section 11-0907 of the Environmental Conservation Law by adding a new
item (m) to allow rifle hunting of big game in Onondaga County from the
first Saturday after November 15 through the first Sunday after December
7.

Section 4 of this bill would amend Item (f) of paragraph a of subdivi-
sion 2 of section 11-0907 of the Environmental Conservation Law to
include a new item (m) to allow rifle hunting of big game in Onondaga
County from the first Monday after November 15 through the first Tuesday
after December 7.

Section 5 of this bill provides that the effective date shall take
effect immediately.

 
JUSTIFICATION:

Big game hunting, which includes the hunting of deer and bear, is a
popular sport enjoyed by over 700,000 State residents each year.
Currently, hunters across the State are permitted to use certain types
of firearms to hunt big game. However, two upstate counties are not
authorized to hunt big game with rifles - Onondaga and Livingston Coun-
ties.

Hunting is a sport thousands of State residents enjoy every year, it is
also a crucial conservation tool that keeps deer and bear populations in
check. Due to a variety of factors, the State's deer population has
rapidly increased to over 1.2 million. Deer overabundance can negatively
impact farmers, homeowners, and foresters, while also causing road
hazards across the State.  According to the Department of Environmental

Conservation hunters take around 220,000 deer annually, reducing the
problems that accompany deer overabundance.

Since 2005, several counties in the Finger Lakes Region, Central New
York, and the Southern Tier have permitted hunting big game with rifles
with very few reported incidents or problems. Most recently, in 2020,
Tompkins County was authorized for the use of rifles in hunting big
game. In that timespan, there have been no serious incidents reported.
This bill would authorize big game hunting with rifles in Onondaga Coun-
ty.

 AN ACT to amend the environmental conservation law, in relation  to  big
   game  hunting  authorization for the county of Onondaga; and providing
   for the repeal of such provisions upon expiration thereof

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Paragraph  a  of  subdivision 2 of section 11-0907 of the
 environmental conservation law is amended by adding a new  item  (p)  to
 read as follows:
   (P) THE COUNTY OF      DEER, THE FIRST            PISTOL, SHOTGUN,
   ONONDAGA               SATURDAY AFTER NOVEMBER    CROSSBOW, MUZZLE
                          15 THROUGH FIRST SUNDAY    LOADING FIREARM,
                          AFTER DECEMBER 7           RIFLE OR LONG BOW
   §  2.  Item  (f) of paragraph a of subdivision 2 of section 11-0907 of
 the environmental conservation law, as amended by section 2  of  chapter
 152 of the laws of 2020, is amended to read as follows:
   (f) Southern tier,     Deer, first                Pistol, shotgun,
   central and Western    Monday after November      crossbow,
   region, except those   15 through first           muzzle loading
   counties or portions   Tuesday after              firearm or
   thereof listed in      December 7                 long bow only
   item (i), (j), (k),
   (l), (m), (n) [or],

   of this paragraph
   §  3.  Paragraph a of subdivision 2 of section 11-0907 of the environ-
 mental conservation law is amended by adding a new item (n) to  read  as
 follows:
   (N) THE COUNTY OF      DEER AND BEAR, THE         PISTOL, SHOTGUN,
   ONONDAGA               FIRST SATURDAY AFTER       CROSSBOW, MUZZLE

   §  4.  Item  (f) of paragraph a of subdivision 2 of section 11-0907 of

   § 5. This act shall take effect immediately; provided, however, that:
   a.  the  amendments to paragraph a of subdivision 2 of section 11-0907
 of the environmental conservation law made by section one  of  this  act
 shall  be  subject  to  the  expiration  and reversion of such paragraph
 pursuant to section 13 of chapter 600 of the laws of 1993, as amended;
   b. the amendments to item (f) of  paragraph  a  of  subdivision  2  of
 section  11-0907  of  the environmental conservation law made by section
 two of this act shall be subject to the expiration and reversion of such
 item pursuant to paragraph d of section 5 of chapter 152 of the laws  of
 2020, as amended by section five of this act;
   c.  sections  three  and  four  of this act shall take effect upon the
 expiration and reversion of paragraph a  of  subdivision  2  of  section
 11-0907 of the environmental conservation law, as provided in section 13
 of chapter 600 of the laws of 1993, as amended; and
   d.  nothing  contained  in this act shall be construed so as to extend
 the provisions of this act beyond October 1, 2025, when upon  such  date
 this  act  shall  expire  and  the  provisions contained herein shall be
 deemed repealed.
