BILL NUMBER: S6316 SPONSOR: ROLISON TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to a license to sell liquor at retail for consumption on certain premises PURPOSE: The purpose of this bill is to provide the Silk Factory in the City of Newburgh an exemption from the 200-foot rule so they can use their Wash- ington Street entrance to obtain a liquor license. SUMMARY OF PROVISIONS: § 1 adds paragraph (e-15) to subdivision 7 of section 64-a of the alco- holic beverage control law. This paragraph outline the metes and bounds of the establishment, which are within 200 feet of a church and provide an exemption to obtain a liquor license. § 2 is the effective date.

ROLISON -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the alcoholic beverage control law, in relation to a license to sell liquor at retail for consumption on certain premises THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 7 of section 64 of the alcoholic beverage control law is amended by adding a new paragraph (e-15) to read as follows: (E-15) NOTWITHSTANDING THE PROVISIONS OF PARAGRAPH (A) OF THIS SUBDI- VISION, THE AUTHORITY MAY ISSUE A RETAIL LICENSE FOR ON-PREMISES CONSUMPTION FOR A PREMISES WHICH SHALL BE LOCATED WITHIN TWO HUNDRED FEET OF A BUILDING OCCUPIED AS A CHURCH, SYNAGOGUE OR OTHER PLACE OF WORSHIP, PROVIDED SUCH PREMISES CONSTITUTE A PREMISES FOR THE SALE OF FOOD OR BEVERAGES AT RETAIL FOR CONSUMPTION ON THE PREMISES LOCATED WHOLLY WITHIN THE BOUNDARIES OF THE CITY OF NEWBURGH, COUNTY OF ORANGE, BOUNDED AND DESCRIBED AS FOLLOWS: ALL THAT PLOT, PIECE, OR PARCEL OF LAND SITUATE, LYING AND BEING IN THE CITY OF NEWBURGH, ORANGE COUNTY, NEW YORK, BOUNDED AND DESCRIBED AS FOLLOWS: BEGINNING AT A POINT ON THE SOUTHERLY SIDE OF WASHINGTON STREET, SAID POINT BEING IN THE DIVISION LINE BETWEEN LOT 266 ON THE WEST AND LANDS NOW OR FORMERLY AGNELLO (LOT 267) LIBER 6001 PAGE 317 ON THE EAST, AND RUNNING; THENCE 1. ALONG LANDS NOW OR FORMERLY AGNELLO (LOT 267), S. 04°-53'-32" W. 100.00' TO A POINT IN LOT 209; THENCE 2. ALONG LOTS 209 AND 210, N. 85°-13'-58" W. 50.00' TO A POINT IN LOT 264; THENCE 3.
