BILL NUMBER: S6482 SPONSOR: MANNION TITLE OF BILL: An act to amend the civil service law, in relation to allowing an indi- vidual with disabilities or a disabled veteran to hold two part-time positions equivalent to a full-time position for purposes of eligibility for recruitment for state employment PURPOSE: The purpose of this bill is to specify that positions offered by the Department of Civil Service to persons with disabilities may be filled on a full-time or part-time basis. SUMMARY OF PROVISIONS: Section 1 of this bill would amend section 55-b of the Civil Service Law by specifying that positions offered by the Department of Civil Service to persons with disabilities may be filled on a full-time or part-time basis.

MANNION -- read twice and ordered printed, and when printed to be committed to the Committee on Civil Service and Pensions AN ACT to amend the civil service law, in relation to allowing an indi- vidual with disabilities or a disabled veteran to hold two part-time positions equivalent to a full-time position for purposes of eligibil- ity for recruitment for state employment THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 55-b of the civil service law, as amended by chapter 603 of the laws of 1995, is amended and a new subdi- vision 3 is added to read as follows: 1. The commission may determine up to twelve hundred positions with duties such as can be performed by persons with a physical or mental disability who are found otherwise qualified to perform satisfactorily the duties of any such position, WHETHER ON A FULL-TIME OR PART-TIME BASIS. Upon such determination the said positions shall be classified in the noncompetitive class, and may be filled only by persons who shall have been certified by the employee health service of the department as being a person with either a physical or mental disability. The number of persons appointed pursuant to this section shall not exceed twelve hundred. 3. EMPLOYEES HIRED UNDER THIS SECTION MAY BE EMPLOYED FULL-TIME IN A SINGLE POSITION OR PART-TIME IN TWO POSITIONS IDENTIFIED PURSUANT TO SUBDIVISION ONE OF THIS SECTION. § 2. Subdivision 1 of section 55-c of the civil service law, as amended by chapter 340 of the laws of 2008, is amended and a new subdi- vision 4 is added to read as follows: 1. The commission may determine up to five hundred positions with duties such as can be performed by disabled veterans and veterans with disabilities who are found otherwise qualified to perform satisfactorily the duties of any such position, WHETHER ON A FULL-TIME OR PART-TIME EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
