BILL NUMBER: S6641 SPONSOR: RIVERA TITLE OF BILL: An act to amend the public health law, in relation to licensure require- ments and reimbursements for certain home health services PURPOSE: Provides for reimbursements for certain home health services that meet the definition of core public health services SUMMARY OF SPECIFIC PROVISIONS: Section 1 amends section 3605 of Public Health Law, as it relates to licensure of home care service agencies, by adding two new subdivisions 1-a and 1-b, to allow core public health services provided in the home by local departments of a county or of the city of New York to provide patient care without licensure and be eligible for reimbursement if services provided meet federal and state requirements for such reimbursement.

RIVERA -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to licensure require- ments and reimbursements for certain home health services THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3605 of the public health law is amended by adding two new subdivisions 1-a and 1-b to read as follows: 1-A. CORE PUBLIC HEALTH SERVICES, AS DEFINED IN SECTION SIX HUNDRED TWO OF THIS CHAPTER, WHEN PROVIDED IN THE HOME BY THE LOCAL HEALTH DEPARTMENT OF A COUNTY OR OF THE CITY OF NEW YORK, SHALL NOT REQUIRE LICENSURE UNDER THIS SECTION, PROVIDED THAT SUCH SERVICES SHALL NOT INCLUDE: HOME HEALTH AIDE SERVICES; PERSONAL CARE SERVICES; OR NURSING SERVICES THAT REQUIRE MORE THAN MINIMAL PATIENT CONTACT. FOR THE PURPOSES OF THIS SUBDIVISION THE TERM "MINIMAL PATIENT CONTACT" INCLUDES, BUT IS NOT LIMITED TO, PROVIDING ASSESSMENTS OF NEW MOTHERS AND INFANTS, DIRECT OBSERVATION, AND LEAD SCREENING. PATIENT CONTACT SHALL BE CONSIDERED MORE THAN MINIMAL IF IT REQUIRES MORE THAN SIX PATIENT VISITS, EXCEPT WHERE THE SAME SERVICES CAN BE PROVIDED BY EITHER NURSE OR NON-NURSE PERSONNEL, THERE SHALL BE NO LIMIT ON THE NUMBER OF VISITS NECESSARY TO PROVIDE THE CORE PUBLIC HEALTH SERVICES. CORE PUBLIC HEALTH SERVICES THAT MAY BE PROVIDED WITHOUT A LICENSE PURSUANT TO THIS SUBDIVISION INCLUDE BUT ARE NOT LIMITED TO: IMMUNIZATIONS; TEST- ING FOR TUBERCULOSIS AND OBSERVATION OF TUBERCULOSIS SELF-DIRECTED THER- APY; VERBAL ASSESSMENT, COUNSELING AND REFERRAL SERVICES; AND SUCH OTHER SERVICES AS MAY BE DETERMINED BY THE DEPARTMENT. 1-B. CORE PUBLIC HEALTH SERVICES, AS DEFINED IN SECTION SIX HUNDRED TWO OF THIS CHAPTER, WHEN PROVIDED BY LOCAL HEALTH DEPARTMENTS IN THE HOME AS AUTHORIZED UNDER SUBDIVISION ONE-A OF THIS SECTION, MAY BE ELIGIBLE FOR REIMBURSEMENT UNDER TITLE XIX OF THE FEDERAL SOCIAL SECURI- TY ACT PROVIDED THAT THE SERVICES PROVIDED MEET FEDERAL AND STATE REQUIREMENTS FOR SUCH REIMBURSEMENT. § 2. BILL NUMBER: S6641A SPONSOR: RIVERA TITLE OF BILL: An act to amend the public health law, in relation to licensure require- ments and reimbursements for certain home health services PURPOSE:: Provides for reimbursements for certain home health services that meet the definition of core public health services SUMMARY OF SPECIFIC PROVISIONS: Section 1 adds a new section 610 to the public health law that allows a nurse to visit the home and provide a core public health service, with- out being subject to licensure, so long as it follows statutory require- ments and is not intended to serve as nursing services. The commissioner of health may determine if the services exceed the limits of the scope of public health services, as well as establish the requirements for reimbursement.

NOTWITH- STANDING ANY OTHER PROVISION OF LAW, A VISIT TO THE HOME BY A NURSE TO PROVIDE A CORE PUBLIC HEALTH SERVICE, AS DEFINED IN SECTION SIX HUNDRED TWO OF THIS ARTICLE, BY A COUNTY OR CITY PUBLIC HEALTH AGENCY THAT RECEIVES FUNDING UNDER THIS ARTICLE AND THAT IS FOR PURPOSES OF MEETING STATUTORY REQUIREMENTS OF THIS ARTICLE, AND IS NOT INTENDED TO SERVE AS NURSING SERVICES WITHIN THE MEANING OF ARTICLE THIRTY-SIX OF THIS CHAP- TER, SHALL NOT OTHERWISE BE SUBJECT TO LICENSURE UNDER ANY OTHER PROVISION OF LAW. 2. IF THE COMMISSIONER DETERMINES THAT THE SCOPE OF SERVICES PROVIDED BY A LOCAL HEALTH DEPARTMENT ESTABLISHED UNDER THIS SECTION EXCEEDS THE LIMITS PRESCRIBED, HE OR SHE MAY REQUIRE THAT SUCH CITY OR COUNTY PUBLIC HEALTH AGENCY BE SUBJECT TO THE REQUIREMENTS SET FORTH IN ARTICLE THIR- TY-SIX OF THIS CHAPTER. 3.
