BILL NUMBER: S6977 SPONSOR: SALAZAR TITLE OF BILL: An act to amend the correction law, in relation to clarifying the defi- nition of persons with a disability for purposes of the definition of special populations PURPOSE: To clarify the intent of the HALT Solitary Confinement law (Chapter 93 of the Laws of 2021) that individuals with recognized and diagnosed mental health disorders or illnesses are part of the "special popu- lations" excluded from segregated confinement. SUMMARY OF PROVISIONS: Section 1 amends paragraph ( c) of subdivision 33 of section 2 of the correction law, as added by chapter 93 of the Laws of 2021, by adding language that makes clear the intent of the original law, to ban all individuals with mental health diagnosis, people on the OMH case-load,

SALAZAR -- read twice and ordered printed, and when printed to be committed to the Committee on Crime Victims, Crime and Correction AN ACT to amend the correction law, in relation to clarifying the defi- nition of persons with a disability for purposes of the definition of special populations THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (c) of subdivision 33 of section 2 of the correction law, as added by chapter 93 of the laws of 2021, is amended to read as follows: (c) with a disability as defined in paragraph (a) of subdivision twen- ty-one of section two hundred ninety-two of the executive law, INCLUDING BUT NOT LIMITED TO: (I) ALL PEOPLE WITH ANY MENTAL HEALTH DIAGNOSIS; (II) ALL PEOPLE ON THE OFFICE OF MENTAL HEALTH CASELOAD CURRENTLY OR WITHIN THE PAST YEAR; (III) ALL PEOPLE WITH ANY INTELLECTUAL, DEVELOP- MENTAL, OR COGNITIVE DIAGNOSIS; (IV) ALL PEOPLE WITH ANY PHYSICAL DISA- BILITY DIAGNOSIS OR MOBILITY IMPAIRMENT; AND (V) ALL PEOPLE WITH ANY SENSORIAL DISABILITY DIAGNOSIS; or § 2.
