TITLE OF BILL:

An act to amend the alcoholic beverage control law, in relation to a
license to sell liquor at retail for consumption on certain premises

 
PURPOSE OR GENERAL IDEA OF BILL:

Relates to a license to sell liquor at retail for consumption on certain
premises

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1: Subdivision 7 of section 64 of the alcoholic beverage control
law is amended by adding a new paragraph (e-15)

Section 2: identifies the effective date.

 
JUSTIFICATION:

The proposed local bill would amend the alcoholic beverage control law
as it relates to the restaurant establishment "Rockin Fish" located at
155 Main Street, Northport, NY, which has been lawfully operating at
that location for approximately 12 years without any citations or inci-
dent. The owners of "Rockin Fish" own and operate another establishment,
Crossroads Cafe for 29 years with a liquor license and have had no cita-
tions or legal issues. The proposed local bill will, not apply anywhere
else in the State of New York. The bill aims to allow the sale of liquor
for on-premises consumption within approximately 185 feet of a religious
building. The religious building in question is the Trinity Episcopal
Church, located at 130 Main Street, Northport, NY. There are no expected
financial implications, and the bill would take effect immediately if
passed.  This bill will enable a singular establishment located in
Northport Village, Suffolk County, to be able to obtain a liquor
license, despite being located less than 200' distance (approximately
185') from a religious building.

 AN  ACT  to  amend  the alcoholic beverage control law, in relation to a
   license to sell liquor at retail for consumption on certain premises

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subdivision  7  of  section  64 of the alcoholic beverage
 control law is amended by adding a  new  paragraph  (e-15)  to  read  as
 follows:
   (E-15)  NOTWITHSTANDING THE PROVISIONS OF PARAGRAPH (A) OF THIS SUBDI-
 VISION, THE  AUTHORITY  MAY  ISSUE  A  RETAIL  LICENSE  FOR  ON-PREMISES
 CONSUMPTION  FOR  A  PREMISES  WHICH SHALL BE LOCATED WITHIN TWO HUNDRED
 FEET OF A BUILDING OCCUPIED AS A SCHOOL, CHURCH, SYNAGOGUE, AND/OR OTHER
 PLACE OF WORSHIP, PROVIDED SUCH PREMISES CONSTITUTE A PREMISES  FOR  THE
 SALE  OF  FOOD  OR  BEVERAGES  AT RETAIL FOR CONSUMPTION ON THE PREMISES
 LOCATED WHOLLY WITHIN THE BOUNDARIES OF THE COUNTY OF  SUFFOLK,  BOUNDED
 AND DESCRIBED AS FOLLOWS:
   ALL  THAT  CERTAIN  PARCEL  OF  LAND,  SITUATE, LYING AND BEING IN THE
 INCORPORATED VILLAGE OF NORTHPORT, TOWN OF HUNTINGTON, COUNTY OF SUFFOLK
 AND STATE OF NEW YORK, BOUNDED AND DESCRIBED AS FOLLOWS:
   BEGINNING AT A POINT ON THE NORTHERLY SIDE OF  MAIN  STREET,  DISTANCE
 403  FEET  (TAX MAP DISTANCE) FROM THE CORNER FORMED BY THE INTERSECTION
 OF THE NORTHERLY SIDE OF MAIN STREET WITH THE WESTERLY SIDE OF  WOODSIDE
 AVENUE,  SAID  POINT  ALSO BEING WHERE THE NORTHERLY LINE OF LAND NOW OR
 FORMERLY OF O. HARTT INTERSECTS THE NORTHERLY SIDE OF MAIN STREET;
   RUNNING THENCE SOUTH 77 DEGREES 26 MINUTES 20 SECONDS WEST  ALONG  THE
 NORTHERLY  SIDE  OF  MAIN  STREET, 50.00 FEET TO LAND NOW OR FORMERLY OF
 ANNIE S. WILD;
