BILL NUMBER: S825 SPONSOR: HOYLMAN TITLE OF BILL: An act to amend the insurance law, in relation to applying coverage requirements for pre-exposure prophylaxis and post-exposure prophylaxis to prevent HIV infection to every large group policy which provides medical, major medical, or comprehensive-type coverage, and repealing certain provisions of such law relating thereto; and to amend a chapter of the laws of 2022 amending the insurance law relating to requiring insurance coverage for pre-exposure prophylaxis and post-exposure prophylaxis to prevent HIV infection, as proposed in legislative bills numbers S. 688 and A. 807, in relation to the effectiveness thereof PURPOSE: This is a chapter amendment that makes changes to provisions of L.2022, c.721, to clarify provisions relating to applying coverage requirements for pre-exposure prophylaxis and post-exposure prophylaxis to prevent HIV infection to health plans in the state.

HOYLMAN -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the insurance law, in relation to applying coverage requirements for pre-exposure prophylaxis and post-exposure prophylax- is to prevent HIV infection to every large group policy which provides medical, major medical, or comprehensive-type coverage, and repealing certain provisions of such law relating thereto; and to amend a chap- ter of the laws of 2022 amending the insurance law relating to requir- ing insurance coverage for pre-exposure prophylaxis and post-exposure prophylaxis to prevent HIV infection, as proposed in legislative bills numbers S. 688 and A. 807, in relation to the effectiveness thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph 21 of subsection (l) of section 3221 of the insurance law, as added by a chapter of the laws of 2022 amending the insurance law relating to requiring insurance coverage for pre-exposure prophylaxis and post-exposure prophylaxis to prevent HIV infection, as proposed in legislative bills numbers S. 688 and A. 807, is amended to read as follows: (21) Every LARGE GROUP policy which provides MEDICAL, MAJOR MEDICAL, OR COMPREHENSIVE-TYPE coverage [for prescription drugs] shall include coverage for the cost of pre-exposure prophylaxis (PrEP) for the prevention of HIV and post-exposure prophylaxis to prevent HIV infection. SUCH COVERAGE MAY BE SUBJECT TO ANNUAL DEDUCTIBLES AND COIN- SURANCE AS MAY BE DEEMED APPROPRIATE BY THE SUPERINTENDENT AND AS ARE CONSISTENT WITH THOSE ESTABLISHED FOR OTHER BENEFITS WITHIN A GIVEN POLICY, UNLESS THE PRE-EXPOSURE PROPHYLAXIS (PREP) OR POST-EXPOSURE PROPHYLAXIS HAS IN EFFECT A RATING OF 'A' OR 'B' IN THE CURRENT RECOM- MENDATIONS OF THE UNITED STATES PREVENTIVE SERVICES TASK FORCE. § 2. Subsection (ss) of section 4303 of the insurance law, as added by a chapter of the laws of 2022 amending the insurance law relating to EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
