BILL NUMBER: S832 SPONSOR: BRISPORT TITLE OF BILL: An act to amend the public health law, in relation to excluding certain runaway youths from being able to consent to certain medical, dental, health and hospital services PURPOSE: This chapter amendment changes provisions of S8937(2022) to clarify what categories of youth can consent to treatment without a parent. SUMMARY OF PROVISIONS: This legislation amends the underlying chapter by striking runaway youth from the pool of youth who can consent to their own medical, dental, health and hospital services. Now homeless youth, and youth who receives services at an approved runaway and homeless youth crisis services program or a transitional independent living support program, both defined in Executive Law § 532-a, can consent to treatment without a

BRISPORT -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the public health law, in relation to excluding certain runaway youths from being able to consent to certain medical, dental, health and hospital services THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 2504 of the public health law, as added by a chapter of the laws of 2022 amending the public health law relating to enabling certain persons to consent for certain medical, dental, health and hospital services, as proposed in legislative bills numbers S. 8937 and A. 9604, is amended to read as follows: 1. Any person who is eighteen years of age or older, or is the parent of a child or has married, or is a [runaway or] homeless youth as defined in section five hundred thirty-two-a of the executive law, or receives services at an approved runaway and homeless youth crisis services program or a transitional independent living support program as defined in section five hundred thirty-two-a of the executive law, may give effective consent for medical, dental, health and hospital services for themself, and the consent of no other person shall be necessary. § 2. This act shall take effect on the same date and in the same manner as a chapter of the laws of 2022 amending the public health law relating to enabling certain persons to consent for certain medical, dental, health and hospital services, as proposed in legislative bills numbers S. 8937 and A. 9604, takes effect.
