TITLE OF BILL:

An act to amend the public health law, in relation to guidelines for
onsite opioid overdose response capacity in nightlife establishments;
and to repeal section 3309-b of such law relating to the nightlife
opioid antagonist program

 
PURPOSE:

This is a chapter amendment that makes changes to provisions of L.2022,
c.  , relating to establishing the nightlife opioid antagonist program.

 
SUMMARY OF PROVISIONS:

The underlying legislation directs the Department of Health (DOH, the
Department) to establish a process for nightlife establishments to apply
to receive at least ten doses of opioid antagonist, free of charge, to
have on site to be administered to patrons in cases of emergency.
Participating programs would be published on the Department's website

and DOH would offer training to establishment staff.

Changes included in this Chapter Amendment wrap nightlife establishments
into the existing opioid overdose prevention program administered by the
Department that entities such as schools, public libraries, restaurants,
bars, stores and shopping malls, barber shops, beauty parlors, theaters,
sportscenters, and inns/hotels currently participate in. Then, setting
any additional guidelines, processes and procedures through the regu-
lations process. Under Public Health Law § 3309 registered participating
entities receive authorization to possess and administer antagonists
they request from DOH (at no cost) onhand under a general
order/prescription, access to training & information on overdose recog-
nition, response and prevention, and inclusion on a public registry on
the DOH website.

This legislation is a negotiated change to the underlying Chapter.

 
LEGISLATIVE HISTORY:

Chapter amendment to Chapter     of the Laws of 2022. S.8633-A and
A.9697-A passed the Senate and Assembly in May and June, respectively.

 
FISCAL IMPLICATIONS:

None

 
EFFECTIVE DATE:
This act shall take effect on the same date and in the same manner as
proposed in legislative bill numbers S.8633-A and A.9697-A; 120 days.

 AN ACT to amend the public health law, in  relation  to  guidelines  for
   onsite  opioid overdose response capacity in nightlife establishments;
   and to repeal section 3309-b of such law  relating  to  the  nightlife
   opioid antagonist program
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 3309-b of the public health  law,  as  added  by  a
 chapter  of  the laws of 2022 amending the public health law relating to
 establishing the nightlife opioid antagonist  program,  as  proposed  in
 legislative bills numbers S. 8633-A and A. 9697-A, is REPEALED.
   §  2.  Paragraph  (a)  of  subdivision 3 of section 3309 of the public
 health law is amended by adding  a  new  subdivision  (vi)  to  read  as
 follows:
   (VI)  "NIGHTLIFE ESTABLISHMENT" MEANS AN ESTABLISHMENT THAT IS OPEN TO
 THE PUBLIC FOR ENTERTAINMENT OR LEISURE, SERVES ALCOHOL OR WHERE ALCOHOL
 IS CONSUMED ON THE PREMISES, AND CONDUCTS A LARGE VOLUME OF BUSINESS  AT
 NIGHT.  SUCH  TERM  INCLUDES, BUT IS NOT LIMITED TO, BARS, ENTERTAINMENT
 VENUES, CLUBS AND RESTAURANTS.
   § 3. Section 3309 of the public health law is amended by adding a  new
 subdivision 8 to read as follows:
   8. THE COMMISSIONER SHALL ESTABLISH GUIDELINES FOR ONSITE OPIOID OVER-
 DOSE RESPONSE CAPACITY IN NIGHTLIFE ESTABLISHMENTS.
   §  4.  This  act  shall  take  effect on the same date and in the same
 manner as a chapter of the laws of 2022 amending the public  health  law
 relating  to  establishing  the  nightlife opioid antagonist program, as
 proposed in legislative bills numbers S. 8633-A  and  A.  9697-A,  takes
 effect.
