 AN ACT to amend the  education  law,  in  relation  to  specifying  that
   certain  teachers,  teacher  aides,  and  teacher  assistants shall be
   included in the excessive teacher turnover prevention program
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The education law is amended by adding a new section 4411
 to read as follows:
   § 4411. INCLUSION IN EXCESSIVE TEACHER TURNOVER PREVENTION PROGRAM. 1.
 FOR THE PURPOSES OF THIS SECTION, THE TERM "COVERED SCHOOL" SHALL MEAN A
 SCHOOL OR PRESCHOOL RECEIVING FUNDING UNDER SECTION  FORTY-FOUR  HUNDRED
 TEN  OF  THIS ARTICLE FOR THE PROVISION OF SPECIAL EDUCATION, AS DEFINED
 BY SUBDIVISION ONE OF SECTION FORTY-FOUR HUNDRED ONE  OF  THIS  ARTICLE,
 AND  SHALL  INCLUDE  PRIVATE  SCHOOLS  ESTABLISHED  UNDER  CHAPTER EIGHT
 HUNDRED FIFTY-THREE OF THE LAWS OF NINETEEN HUNDRED SEVENTY-SIX.
   2. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, RULE OR REGULATION, THE
 DEPARTMENT'S EXCESSIVE TEACHER TURNOVER PREVENTION PROGRAM SHALL INCLUDE
 SUPPORT FOR TEACHERS, TEACHER AIDES, AND TEACHER ASSISTANTS WHOSE DUTIES
 INCLUDE WORKING WITH CHILDREN WITH A DISABILITY, AND WHO ARE EMPLOYED BY
 A COVERED SCHOOL.
   § 2. This act shall take effect immediately.
