 AN ACT to amend the executive law, in relation to requiring the division
   of  criminal justice to create and disseminate to police departments a
   video on bicycles with electric assist and electric scooters
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 837 of the executive law is amended by adding a new
 subdivision 25 to read as follows:
   25.  IN  COOPERATION  WITH  THE  DEPARTMENT  OF MOTOR VEHICLES AND THE
 DEPARTMENT OF TRANSPORTATION, CREATE AND DISSEMINATE TO  POLICE  DEPART-
 MENTS  A  VIDEO  ON BICYCLES WITH ELECTRIC ASSIST AND ELECTRIC SCOOTERS.
 SUCH VIDEO SHALL INCLUDE, BUT NOT BE LIMITED TO, THE FOLLOWING  INFORMA-
 TION:
   (A)  LEGAL  CLASSIFICATION  AND  DEFINITIONS OF BICYCLES WITH ELECTRIC
 ASSIST AND ELECTRIC SCOOTERS, INCLUDING A VISUAL BREAKDOWN OF CLASSES OF
 BICYCLES WITH ELECTRIC ASSIST AND SCOOTERS, AND COMMON MISIDENTIFICATION
 ISSUES, SUCH AS THROTTLE VERSUS PEDAL-ASSIST;
   (B) WHERE SUCH DEVICES MAY LEGALLY OPERATE, INCLUDING ADDRESSING OPER-
 ATION ON STREETS, BICYCLE LANES, AND SIDEWALKS, IN PARKS AND ON  SHARED-
 USE PATHS, AND LOCAL OPT-OUT RULES;
   (C)  SPEED LIMITS AND ENFORCEMENT GUIDANCE, INCLUDING WHEN SPEED MEAS-
 UREMENT IS REQUIRED VERSUS WHEN OBSERVATIONAL ENFORCEMENT IS PERMISSIBLE
 AND THE LEGAL IMPORTANCE OF SPEED VERSUS THE PRACTICAL IMPORTANCE;
   (D) HELMET AND AGE REQUIREMENTS, INCLUDING WHEN STOPS OR  THE  ISSUING
 OF A SUMMONS IS APPROPRIATE AND WHEN WARNINGS OR EDUCATION IS PREFERRED;
 AND
   (E)  A  REVIEW OF LEGAL OPERATION OF SUCH DEVICES, INCLUDING RIDING IN
 BICYCLE LANES, USING PEDAL-ASSIST, AND LAWFUL DEVICES OPERATING  WITHOUT
 REGISTRATION OR INSURANCE.
   § 2. This act shall take effect immediately.
