Establishes the adult care facility voucher demonstration program for persons with dementia, Alzheimer's diagnosis, or other cognitive impairments to provide a sliding-scale subsidy for adult care facility residents who are at risk of losing nursing home care due to depleted resources and to individuals who are not eligible for Medicaid or supplemental security income, but in need of adult day care services.

 AN ACT  establishing  the  adult  care  facility  voucher  demonstration
   program;  and providing for the repeal of such provisions upon expira-
   tion thereof
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section  1. 1. Notwithstanding any other provision of law, the depart-
 ment of health shall establish and implement, the  adult  care  facility
 voucher  demonstration  program  for  persons with dementia, Alzheimer's
 diagnosis, or other cognitive impairments.
   2. In at least three counties, representing urban, suburban and  rural
 settings,  such  program shall provide a sliding-scale subsidy for adult
 care facility residents who are at risk of losing nursing home care  due
 to  depleted resources and to individuals who are not eligible for Medi-
 caid or supplemental security income, but in  need  of  adult  day  care
 services.
   3.  Such program shall examine whether such subsidy pursuant to subdi-
 vision two of this section can reduce or delay the need for nursing home
 care by assisting seniors to remain living within their community or  in
 their  assisted living residence or adult care facility while generating
 a Medicaid savings.
   4. An assessment of the possible creation of a  similar  demonstration
 for individuals who are at risk for Medicaid-funding nursing home place-
 ment,  but  would  benefit  from  partially  subsidized  adult  day care
 services.
   ยง 2. This act shall take effect immediately and shall  expire  and  be
 deemed repealed three years after the effective date of this act.
