AN ACT in relation to the alienation of certain parklands by the Village
of Southampton in the Town of Southampton in the County of Suffolk
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Subject to the provisions of this act, the village of
Southampton, located in the town of Southampton, county of Suffolk,
acting by and through its governing body and upon such terms and condi-
tions as determined by such body, is hereby authorized to discontinue as
parklands and alienate the lands described in section three of this act
for the purpose of constructing a new wastewater treatment facility.
§ 2. The authorization provided for in section one of this act shall
be effective only upon the condition that the village of Southampton
dedicates the lands described in section four of this act as parkland,
provided that such lands have never been used for public open space or
municipal park purposes.
§ 3. The parklands authorized by section one of this act to be discon-
tinued are described as follows:
ALL that certain piece or parcel of land situate in the Village and Town
of Southampton, County of Suffolk, State of New York, more particularly
bounded and described as follows: BEGINNING at a point formed by the
intersection of the westerly line of Windmill Lane and the southerly
line of lands now or formerly of Augustus Marshall Estate, said point
being situate South 5° 09' 00" West 303.92 feet from a granite monument
set at the intersection of the westerly line of Windmill Lane and the
southerly line of White Street and running thence from the point of
beginning southerly along the westerly line of Windmill Lane South 5°
09' 00" West 184.22 feet to lands now or formerly of Mrs. Gilbert White;
thence westerly along lands now or formerly of Mrs. Gilbert White North
83° 08' 30" West 582.55 feet to a monument; thence northerly along lands
now or formerly of Mrs. Gilbert White North 0° 43' 10" West 182.11 feet
to a monument and lands now or formerly of Frank Postwaitowski; thence
easterly along lands now or formerly of Frank Postwaitowski; lands now

or formerly of Annie Benett and lands now or formerly of Augustus Mars-
hall Estate, and passing through a monument South 83° 29' 10" East
601.09 feet to the point or place of beginning; containing 2.478 acres
of land.
§ 4. Prior to the discontinuance and alienation of the parklands
described in section three of this act, the village of Southampton shall
dedicate as parkland the land described as follows:
All that certain plot, piece, or parcel of land, situate, lying and
being in the Village of Southampton, Town of Southampton, County of
Suffolk, and State of New York, being bounded and described as follows:
BEGINNING at a point on the westerly side of Windmill Lane (S.R. 27A)
the following two (2) courses and distances from the extreme northerly
end of the arc of a curve connecting the westerly side of Windmill Lane
(S.R. 27A) and the northerly side of Coopers Farm Road:
1. North 05 degrees 42 minutes 28 seconds East 292.81 feet;
2. North 07 degrees 25 minutes 28 seconds West 251.40 feet;
RUNNING THENCE South 82 degrees 58 minutes 17 seconds West 192. 71
feet;
THENCE South 10 degrees 41 minutes 57 seconds East 84.87 feet;
THENCE South 79 degrees 18 minutes 03 seconds West 80.00 feet;
THENCE North 10 degrees 41 minutes 57 seconds West 237.68 feet;
THENCE South 85 degrees 02 minutes 06 seconds East 281.57 feet to the
westerly side of Windmill Lane (S.R. 27A);
THENCE along the westerly side of Windmill Lane (S.R. 27 A), South 07
degrees 25 minutes 28 seconds East 137.24 feet to the point or place of
BEGINNING; containing 1.10 acres of land.
§ 5. In the event that the fair market value of the parklands
described in section four of this act to be dedicated by the village of
Southampton pursuant to this act are not equal to or greater than the
fair market value of the parklands to be discontinued as described in
section three of this act, the village of Southampton shall dedicate the
difference of the fair market value of the lands to be discontinued and
the lands to be dedicated for the acquisition of additional parklands
and/or capital improvements to existing park and recreational facili-
ties.
§ 6. In the event that the village of Southampton received any funding
support or assistance from the federal government for the purchase,
maintenance or improvement of the parklands set forth in section three
of this act, the discontinuance and alienation of such parkland author-
ized by the provisions of this act shall not occur until the village of
Southampton has complied with any federal requirements pertaining to the
alienation or conversion of parklands, including satisfying the secre-
tary of the interior that the alienation or conversion complies with all
conditions which the secretary of the interior deems necessary to assure
the substitution of other lands shall be equivalent in fair market value
and usefulness to the lands being alienated or converted.
§ 7. This act shall take effect immediately.
