2025-A10458 (ACTIVE) - Summary

Provides that a claimant for unemployment benefits may claim an additional dependent allowance in an amount equal to 5% of the state average weekly wage for the current benefit year multiplied by the number of dependents claimed in the preceding tax year.

 AN ACT to amend the labor law, in  relation  to  including  a  dependent
   allowance with unemployment benefits
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision 5 of section 590 of the labor law is amended by
 adding a new paragraph (d) to read as follows:
   (D) IN ADDITION TO ANY BENEFITS PROVIDED UNDER PARAGRAPH (A)  OF  THIS
 SUBDIVISION, A CLAIMANT WHO CLAIMED DEPENDENTS ON THEIR STATE INCOME TAX
 RETURN  FILED  IN  THE  TAX  YEAR  PRECEDING THE YEAR IN WHICH THE VALID
 ORIGINAL UNEMPLOYMENT CLAIM WAS APPROVED SHALL BE ELIGIBLE TO RECEIVE  A
 DEPENDENT  ALLOWANCE.  SUCH DEPENDENT ALLOWANCE SHALL BE AN AMOUNT EQUAL
 TO FIVE PERCENT OF THE AVERAGE WEEKLY WAGE FOR THE CURRENT BENEFIT  YEAR
 MULTIPLIED  BY  THE  NUMBER  OF  DEPENDENTS CLAIMED IN THE PRECEDING TAX
 YEAR.
   § 2. This act shall take effect immediately.
