 AN  ACT  to  amend the racing, pari-mutuel wagering and breeding law, in
   relation to prohibiting mobile sports wagering operators  from  condi-
   tioning  the withdrawal of funds on a requirement that a sports bettor
   first wager deposited funds

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. Subdivision 5 of section 1367-a of the racing, pari-mutuel
 wagering and breeding law is amended by adding a new  paragraph  (c)  to
 read as follows:
   (C)  NO  MOBILE  SPORTS  WAGERING  OPERATOR SHALL IMPOSE ANY CONDITION
 REQUIRING AN AUTHORIZED SPORTS BETTOR TO  WAGER  DEPOSITED  FUNDS  AS  A
 PREREQUISITE  TO  WITHDRAWING  SUCH  FUNDS.  AN AUTHORIZED SPORTS BETTOR
 SHALL BE PERMITTED TO WITHDRAW ANY UN-WAGERED DEPOSITED FUNDS FROM  SUCH
 BETTOR'S  ACCOUNT AT ANY TIME, SUBJECT ONLY TO IDENTITY VERIFICATION AND
 FRAUD PREVENTION MEASURES APPROVED BY  THE  COMMISSION.  ANY  POLICY  OR
 PRACTICE THAT RESTRICTS, DELAYS, OR CONDITIONS THE WITHDRAWAL OF UN-WAG-
 ERED  DEPOSITED  FUNDS  IN  A  MANNER INCONSISTENT WITH THIS SUBDIVISION
 SHALL CONSTITUTE A VIOLATION OF THIS SECTION AND  SHALL  BE  SUBJECT  TO
 ENFORCEMENT BY THE COMMISSION PURSUANT TO THIS ARTICLE.
   §  2.  This  act  shall take effect on the sixtieth day after it shall
 have become a law. Effective immediately, the addition, amendment and/or
 repeal of any rule or regulation necessary  for  the  implementation  of
 this  act  on its effective date are authorized to be made and completed
 on or before such effective date.
