 AN ACT to amend the criminal procedure  law,  in  relation  to  granting
   peace  officer  status  to certain employees of the Parkchester police
   department of public safety
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section  1.  Section  2.10 of the criminal procedure law is amended by
 adding a new subdivision 88 to read as follows:
   88. (A) EMPLOYEES OF THE PARKCHESTER POLICE DEPARTMENT OF PUBLIC SAFE-
 TY, IN THE BOROUGH OF THE BRONX,  CITY  OF  NEW  YORK,  WHO  PATROL  THE
 PARKCHESTER  NORTH  AND SOUTH CONDOMINIUM AREA CONSISTING OF ONE HUNDRED
 SEVENTY-ONE RESIDENTIAL BUILDINGS AND THE SUPPORTIVE COMMERCIAL DISTRICT
 ON APPROXIMATELY ONE HUNDRED TWENTY-NINE ACRES WITHIN BRONX  COUNTY  AND
 THE  PUBLIC  ROADWAYS THEREIN AND APPOINTED BY SUCH POLICE DEPARTMENT AS
 PEACE OFFICERS; PROVIDED, HOWEVER, THAT  THE  EXERCISE  OF  SUCH  POWERS
 SHALL  BE  LIMITED  TO  (I)  SUCH EMPLOYEES' ACTUAL PERFORMANCE OF THEIR
 DUTIES, AND (II) THE GEOGRAPHICAL AREA  OF  THE  PARKCHESTER  NORTH  AND
 SOUTH  CONDOMINIUMS  INCLUDING INGRESS AND EGRESS ROADWAYS COMMONLY USED
 BY RESIDENTS AND VISITORS FOR ACCESS  TO  SUCH  PROPERTY;  AND  PROVIDED
 FURTHER  THAT  NOTHING  IN THIS SUBDIVISION SHALL BE DEEMED TO AUTHORIZE
 SUCH EMPLOYEES TO CARRY, POSSESS, REPAIR OR DISPOSE OF A FIREARM  UNLESS
 AUTHORIZED  AND  TRAINED  PURSUANT  TO  SECTION 2.30 OF THIS ARTICLE AND
 OTHER APPLICABLE LAW.
   (B) PRIOR TO PERFORMING THE DUTIES PERMITTED UNDER THIS SUBDIVISION, A
 PERSON SHALL HAVE SUCCESSFULLY COMPLETED THE TRAINING  REQUIREMENTS  SET
 FORTH  IN  SECTION 2.30 OF THIS ARTICLE AND ANY ADDITIONAL PEACE OFFICER
 TRAINING REQUIRED BY THE MUNICIPAL POLICE TRAINING COUNCIL IN ACCORDANCE
 WITH SECTION EIGHT HUNDRED THIRTY-NINE OF THE EXECUTIVE LAW.
   § 2. This act shall take effect immediately.
