 AN  ACT  to amend the insurance law, in relation to prohibiting insurers
   from using violations committed by child care providers as  the  basis
   for rate adjustments
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The insurance law is amended by adding a new section 2335-b
 to read as follows:
   § 2335-B. PROHIBITION ON  CERTAIN  RATE  ADJUSTMENTS  FOR  CHILD  CARE
 PROVIDERS. AN INSURER AUTHORIZED TO WRITE AND ISSUE COMMERCIAL LIABILITY
 INSURANCE  OR  ANY  OTHER POLICY COVERING A CHILD CARE PROVIDER, AS SUCH
 TERM IS DEFINED BY SECTION THREE HUNDRED NINETY OF THE  SOCIAL  SERVICES
 LAW, SHALL NOT BASE ANY PREMIUM RATE ADJUSTMENT FOR SUCH A POLICY SOLELY
 ON A VIOLATION ISSUED BY THE NEW YORK STATE OFFICE OF CHILDREN AND FAMI-
 LY  SERVICES PURSUANT TO TITLE ONE OF ARTICLE SIX OF THE SOCIAL SERVICES
 LAW OR ANY REGULATION PROMULGATED THEREUNDER.
   § 2. This act shall take effect immediately.
