 AN  ACT  to amend the cannabis law, in relation to prohibiting adult-use
   cannabis dispensaries from being located within a certain distance  of
   the property boundary of a public school, public park, or beach
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision 6 of section 72 of the cannabis law is  amended
 by adding a new paragraph (a-1) to read as follows:
   (A-1)  (I) NO PREMISES WITH A LICENSE ISSUED PURSUANT TO THIS SECTION,
 OR SECTION SIXTY-EIGHT-A OF THIS ARTICLE, OR  SECTION  SEVENTY-THREE  OF
 THIS  ARTICLE  THAT  ALLOWS  FOR  THE RETAIL SALE OF ADULT-USE CANNABIS,
 SHALL BE LOCATED WITHIN ONE THOUSAND FEET OF THE  PROPERTY  BOUNDARY  OF
 ANY PUBLIC SCHOOL, PUBLIC PARK, OR PUBLIC BEACH.
   (II)  FOR  PURPOSES OF THIS PARAGRAPH, DISTANCE SHALL BE MEASURED IN A
 STRAIGHT LINE FROM THE CENTER OF THE NEAREST ENTRANCE  OF  THE  PREMISES
 SOUGHT  TO  BE LICENSED TO THE NEAREST POINT OF THE PROPERTY BOUNDARY OF
 SUCH PUBLIC SCHOOL, PUBLIC PARK, OR  PUBLIC  BEACH,  WITHOUT  REGARD  TO
 INTERVENING BUILDINGS, STRUCTURES, OR ZONING DISTRICT LINES.
   (III) FOR PURPOSES OF THIS PARAGRAPH:
   (1)  "PUBLIC  SCHOOL"  SHALL  MEAN  ANY ELEMENTARY OR SECONDARY SCHOOL
 OPERATED BY A SCHOOL DISTRICT OR OTHER PUBLIC ENTITY OF THE STATE.
   (2) "PUBLIC PARK" SHALL MEAN ANY PARK, PLAYGROUND, RECREATION AREA, OR
 SIMILAR FACILITY OWNED, LEASED OR OPERATED BY THE STATE OR ANY POLITICAL
 SUBDIVISION THEREOF AND DESIGNATED OR USED PRIMARILY FOR  PUBLIC  RECRE-
 ATION.
   (3)  "PUBLIC BEACH" SHALL MEAN ANY BATHING BEACH, SHORELINE, OR WATER-
 FRONT AREA OWNED, LEASED OR OPERATED  BY  THE  STATE  OR  ANY  POLITICAL
 SUBDIVISION THEREOF AND DESIGNATED OR REGULARLY USED FOR PUBLIC BATHING,
 SWIMMING, OR WATERFRONT RECREATION.
   § 2. This act shall take effect immediately.
