 AN ACT to amend the correction law and the penal law, in relation to the
   early release of incarcerated individuals
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Short title.  This act shall be known and may be  cited  as
 the "earned time act".
   § 2. The correction law is amended by adding a new section 802 to read
 as follows:
   §  802.  DATA  COLLECTION. THE DEPARTMENT SHALL REPORT ANNUALLY TO THE
 GOVERNOR AND THE LEGISLATURE WITH RESPECT TO EACH INSTANCE IN WHICH TIME
 ALLOWANCE CREDIT HAS BEEN WITHHELD, FORFEITED OR CANCELLED.  THE  REPORT
 SHALL  PROVIDE THE FOLLOWING INFORMATION: THE NAME, DEPARTMENT IDENTIFI-
 CATION NUMBER AND RACE OF EACH  INCARCERATED  INDIVIDUAL  WHO  HAS  BEEN
 DENIED  CREDIT  AND THE AMOUNT OF CREDIT INVOLVED, THE REASON OR REASONS
 FOR THE DENIAL, INCLUDING, WHERE APPLICABLE, A DESCRIPTION  OF  THE  BAD
 BEHAVIOR  OR  INSTITUTIONAL  RULE VIOLATION OR VIOLATIONS, INCLUDING THE
 CORRESPONDING NUMERICAL CODE IN THE DEPARTMENT'S  INCARCERATED  INDIVID-
 UAL'S  RULE  HANDBOOK,  AND,  WHERE  APPLICABLE,  A  DESCRIPTION  OF THE
 ASSIGNED DUTY AND/OR IDENTIFICATION OF  ASSIGNED  TREATMENT  PROGRAM  IN
 WHICH  THE  INCARCERATED PERSON WAS DETERMINED TO HAVE FAILED TO PERFORM
 PROPERLY. THE REPORT SHALL ADDITIONALLY SPECIFY THE DEPARTMENT  FACILITY
 IN WHICH THE RECOMMENDATION TO WITHHOLD, FORFEIT OR CANCEL GOOD TIME WAS

This bill has BEEN at a STANDSTILL for YEARS. WHEN are we going to see progress. Year after year. No Progress. The same 2 blue dots showing no progress. New committee members/co sponsors etc. yet, no new progress.

This has been sitting on the back burner for years, it’s ridiculous now. There have been close to 1400 incarcerated men who have died in NYS prison custody over the past 10 years. There are many rehabilitated people amongst the 30,000 in the prisons today. Why should their lives be risked every single day when they are ready & willing to contribute positively to society! PASS THE BILL! My husband’s life is not negotiable or disposable, it is fair and just to base people on their merit! Do the right thing!

I support this bill as many young men and women are currently in prison due to their actions because their frontal lobe was not fully developed at the time of their actions. Frontal lobes are fully developed around the age of 25. This can vary based on genetics, environment and lifestyle. Some of the key functions of the frontal lobe: thinking, reasoning, self-control, maintaining social expectations, planning and abstract thinking. There are many young men and women serving long sentences for actions they have done while this part of their brain was not fully developed. Also many came from an environment where skills were not developed or instilled into them from parents, teacher and other reasonable adults in their lives. Many of these individuals basically grew up in the prison system. This bill will give them a chance to prove they understand what they have done and are able to prove to society that they are willing to be productive.
