 AN ACT to amend the executive law and the state finance law, in relation
   to establishing a public transportation safety grant program and fund;
   and making an appropriation therefor
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The executive law is amended by adding a new section  845-f
 to read as follows:
   § 845-F. PUBLIC TRANSPORTATION SAFETY GRANT PROGRAM. 1. THERE IS HERE-
 BY  ESTABLISHED WITHIN THE DIVISION A PUBLIC TRANSPORTATION SAFETY GRANT
 PROGRAM TO BE ADMINISTERED BY THE COMMISSIONER TO AWARD GRANTS  FOR  THE
 PURPOSE  OF ENHANCING SAFETY INFRASTRUCTURE AT PUBLIC TRANSIT FACILITIES
 THROUGHOUT THE STATE. GRANTS SHALL BE AWARDED TO COUNTIES ON  A  COMPET-
 ITIVE  BASIS,  AND COUNTIES SHALL WORK IN COORDINATION WITH COUNTY SHER-
 IFFS' DEPARTMENTS OR LOCAL LAW ENFORCEMENT AGENCIES, AS WELL AS THE CITY
 OF NEW YORK, TO DEVELOP AND IMPLEMENT PLANS TO  ENHANCE  SAFETY  INFRAS-
 TRUCTURE AT PUBLIC TRANSPORTATION FACILITIES WITHIN THEIR JURISDICTIONS.
 FIFTY PERCENT OF THE FUNDS TO BE APPROPRIATED FOR THE PUBLIC TRANSPORTA-
 TION  SAFETY  GRANT  PROGRAM  SHALL BE MADE AVAILABLE TO THE CITY OF NEW
 YORK AND THE REMAINING FIFTY PERCENT OF SUCH FUNDS SHALL BE MADE  AVAIL-
 ABLE FOR COUNTIES OUTSIDE OF THE CITY OF NEW YORK.
   2.  THE  COMMISSIONER SHALL DEVELOP RULES AND REGULATIONS AS NECESSARY
 TO IMPLEMENT THE PUBLIC TRANSPORTATION SAFETY GRANT  PROGRAM,  INCLUDING
 BUT NOT LIMITED TO: AN APPLICATION PROCESS, THE STANDARDS AND PROCEDURES
 FOR  APPLICATION  APPROVAL,  DEFINITIONS  OF  ELIGIBLE PROJECTS, MAXIMUM
 GRANT AMOUNTS, AUDIT AND REPORTING REQUIREMENTS, AND ANY OTHER RULES  OR
 REGULATIONS  AS  MAY  BE  NECESSARY  TO  EFFECTUATE THE PURPOSES OF THIS
 SECTION.
   3. SUBJECT TO THE AVAILABILITY OF FUNDS WITHIN THE PUBLIC  TRANSPORTA-
 TION  SAFETY  GRANT FUND PURSUANT TO SECTION NINETY-NINE-UU OF THE STATE
 FINANCE LAW, THE COMMISSIONER MAY AWARD GRANTS FOR  UP  TO  SEVENTY-FIVE
 PERCENT OF THE TOTAL PROJECT APPROVED COSTS OF A PROJECT.
