 AN ACT to amend the education law, in  relation  to  permitting  massage
   therapists  licensed  and in good standing in another state or country
   to participate in certain continuing education programs
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section  7805 of the education law is amended by adding a
 new subdivision 7 to read as follows:
   7. A MASSAGE THERAPIST LICENSED AND IN GOOD STANDING IN ANOTHER  STATE
 OR COUNTRY FROM PARTICIPATING IN A DEMONSTRATION OF MODALITIES AND TECH-
 NIQUES  THAT  ARE  WITHIN  THE PRACTICE OF MASSAGE THERAPY IN CONNECTION
 WITH A PROGRAM OF CONTINUING EDUCATION THAT  IS  CONDUCTED  BY  APPROVED
 SPONSORS  OF  CONTINUING EDUCATION BY THE DEPARTMENT, PROVIDED THAT SUCH
 PERSON IS UNDER THE ON-SITE SUPERVISION OF A PERSON LICENSED TO PRACTICE
 MASSAGE THERAPY OR AUTHORIZED TO PRACTICE  MASSAGE  THERAPY  UNDER  THIS
 ARTICLE.  ANY  MASSAGE  THERAPIST  PARTICIPATING  IN  A DEMONSTRATION OF
 MODALITIES AND TECHNIQUES PURSUANT TO THIS SUBDIVISION SHALL BE  SUBJECT
 TO  THE  PERSONAL  AND  SUBJECT MATTER JURISDICTION AND DISCIPLINARY AND
 REGULATORY AUTHORITY OF THE BOARD OF REGENTS AS IF THEY ARE  A  LICENSEE
 AND  AS IF THE EXEMPTION PURSUANT TO THIS SUBDIVISION IS A LICENSE. SUCH
 MASSAGE THERAPISTS SHALL COMPLY WITH THE PROVISIONS OF THIS ARTICLE, THE
 RULES OF THE BOARD OF REGENTS, AND THE REGULATIONS OF THE  COMMISSIONER,
 RELATING TO PROFESSIONAL MISCONDUCT, DISCIPLINARY PROCEEDINGS AND PENAL-
 TIES FOR PROFESSIONAL MISCONDUCT.
   §  2. This act shall take effect one year after it shall have become a
 law. Effective immediately, the addition, amendment and/or repeal of any
 rule or regulation necessary for the implementation of this act  on  its
 effective date are authorized to be made and completed on or before such
 effective date.
