AN ACT to amend the social services law, in relation to requiring Medi-
caid coverage of applied behavior analysis therapy rendered during
school hours
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Subdivision 2 of section 365-a of the social services law
is amended by adding a new paragraph (oo) to read as follows:
(OO) APPLIED BEHAVIOR ANALYSIS THERAPY RENDERED DURING SCHOOL HOURS IN
A PUBLIC OR NON-PUBLIC SCHOOL PROVIDING EDUCATION IN ANY GRADE FROM
KINDERGARTEN THROUGH TWELFTH FOR THE TREATMENT OF AUTISM SPECTRUM DISOR-
DER. FOR THE PURPOSES OF THIS PARAGRAPH, THE TERMS "TREATMENT OF AUTISM
SPECTRUM DISORDER" AND "APPLIED BEHAVIOR ANALYSIS" SHALL HAVE THE SAME
MEANING AS SUCH TERMS ARE DEFINED BY SUBSECTION (EE) OF SECTION FORTY-
THREE HUNDRED THREE OF THE INSURANCE LAW.
§ 2. This act shall take effect on the ninetieth day after it shall
have become a law. Effective immediately, the addition, amendment and/or
repeal of any rule or regulation necessary for the implementation of
this act on its effective date are authorized to be made and completed
on or before such effective date.
