 AN ACT to amend the agriculture and markets law, in relation to  prohib-
   iting  the giveaway or exchange of live fish as prizes in games, draw-
   ing, contests, sweepstakes or promotions
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subdivision  2  of  section  358-a of the agriculture and
 markets law, as amended by chapter 394 of the laws of 2001,  is  amended
 to read as follows:
   2.  No person shall give or offer to give away as a prize, or exchange
 or offer to exchange for nominal consideration, any  live  animal  other
 than purebred livestock [or fish] in any game, drawing, contest, sweeps-
 takes  or  other promotion, except when any live animal is given away by
 individuals or organizations operating in conjunction with a cooperative
 extension education program or  agricultural  vocational  program  sanc-
 tioned by the state education department.
   §  2.  This  act shall take effect on the ninetieth day after it shall
 have become a law. Effective immediately, the addition, amendment and/or
 repeal of any rule or regulation necessary  for  the  implementation  of
 this  act  on its effective date are authorized to be made and completed
 on or before such effective date.
