 AN ACT to amend the public service law, in relation to net energy meter-
   ing for certain residential customer-generators
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Section 66-j of the public service law is amended by adding
 a new subdivision 4-a to read as follows:
   4-A. EXEMPTIONS FOR CERTAIN RESIDENTIAL CUSTOMER-GENERATORS.  NOTWITH-
 STANDING  ANY OTHER PROVISION OF LAW, RULE, OR REGULATION TO THE CONTRA-
 RY, A RESIDENTIAL CUSTOMER-GENERATOR WHO OWNS OR OPERATES SOLAR ELECTRIC
 GENERATING EQUIPMENT LOCATED AND USED AT THE RESIDENCE, AND POWERING  UP
 TO FOUR RESIDENTIAL UNITS, SHALL BE EXEMPT FROM THE VALUE OF DISTRIBUTED
 ENERGY RESOURCES, THE VALUE STACK COMPENSATION METHODOLOGY, OR ANY OTHER
 COMPENSATION  STRUCTURE  THAT PROVIDES ANYTHING OTHER THAN WATT-FOR-WATT
 COMPENSATION, AND SHALL BE CREDITED USING THE NET ENERGY METERING  RATES
 PURSUANT  TO  SUBDIVISION  FOUR OF THIS SECTION. NOTHING IN THIS SECTION
 SHALL  PROHIBIT  INTERCONNECTED  RESIDENTIAL  CUSTOMER-GENERATORS   FROM
 OPTING IN TO A COMPENSATION STRUCTURE, OTHER THAN NET ENERGY METERING.
   § 2. Section 66-l of the public service law is amended by adding a new

 COMPENSATION,  AND SHALL BE CREDITED USING THE NET ENERGY METERING RATES
 PURSUANT TO SUBDIVISION FOUR OF THIS SECTION. NOTHING  IN  THIS  SECTION
 SHALL   PROHIBIT  INTERCONNECTED  RESIDENTIAL  CUSTOMER-GENERATORS  FROM
 OPTING IN TO A COMPENSATION STRUCTURE, OTHER THAN NET ENERGY METERING.
   § 3. This act shall take effect on the sixtieth  day  after  it  shall
 have become a law. Effective immediately, the addition, amendment and/or
 repeal  of  any  rule  or regulation necessary for the implementation of
 this act on its effective date are authorized to be made  and  completed
 on or before such effective date.
