 AN ACT to amend the insurance law, in relation  to  requiring  insurance
   coverage for salpingectomy for ovarian cancer prevention
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Subsection (i) of section 3216  of  the  insurance  law  is
 amended by adding a new paragraph 42 to read as follows:
   (42)  (A) EVERY INSURER OR NONPROFIT HEALTH SERVICE PLAN THAT PROVIDES
 COVERAGE FOR HOSPITAL, MEDICAL OR SURGICAL CARE ON  AN  EXPENSE-INCURRED
 BASIS UNDER HEALTH INSURANCE POLICIES ISSUED OR DELIVERED IN THIS STATE,
 AND  EVERY  HEALTH  MAINTENANCE  ORGANIZATION THAT PROVIDES COVERAGE FOR
 HOSPITAL, MEDICAL OR SURGICAL CARE UNDER CONTRACTS ISSUED  OR  DELIVERED
 IN  THIS  STATE  SHALL  PROVIDE  COVERAGE  FOR SALPINGECTOMY FOR OVARIAN
 CANCER PREVENTION.
   (B) (I) EXCEPT AS  PROVIDED  IN  CLAUSE  (II)  OF  THIS  SUBPARAGRAPH,
 SALPINGECTOMY  COVERAGE  FOR  OVARIAN CANCER PREVENTION REQUIRED BY THIS
 PARAGRAPH SHALL NOT BE SUBJECT TO ANY COPAYMENT, COINSURANCE OR  DEDUCT-
 IBLE REQUIREMENT.
   (II)  IF  AN INSURED OR AN ENROLLEE IS COVERED UNDER A HIGH DEDUCTIBLE
 HEALTH PLAN AS DEFINED IN 26 USC 223, SALPINGECTOMY COVERAGE FOR OVARIAN
 CANCER PREVENTION REQUIRED BY THIS  PARAGRAPH  MAY  BE  SUBJECT  TO  THE
 DEDUCTIBLE REQUIREMENT OF SUCH HIGH DEDUCTIBLE PLAN.
   §  2.  Section  3221  of  the insurance law is amended by adding a new
 subsection (w) to read as follows:
   (W) (1) EVERY INSURER OR NONPROFIT HEALTH SERVICE PLAN  THAT  PROVIDES
 COVERAGE  FOR  HOSPITAL, MEDICAL OR SURGICAL CARE ON AN EXPENSE-INCURRED
 BASIS UNDER HEALTH INSURANCE POLICIES ISSUED OR DELIVERED IN THIS STATE,
 AND EVERY HEALTH MAINTENANCE ORGANIZATION  THAT  PROVIDES  COVERAGE  FOR
 HOSPITAL,  MEDICAL  OR SURGICAL CARE UNDER CONTRACTS ISSUED OR DELIVERED
 IN THIS STATE SHALL  PROVIDE  COVERAGE  FOR  SALPINGECTOMY  FOR  OVARIAN
 CANCER PREVENTION.
   (2)  (A)  EXCEPT  AS  PROVIDED  IN SUBPARAGRAPH (B) OF THIS PARAGRAPH,
 SALPINGECTOMY COVERAGE FOR OVARIAN CANCER PREVENTION  REQUIRED  BY  THIS
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                       [ ] is old law to be omitted.
