 AN ACT to amend the penal law, in relation  to  assault  in  the  second
   degree
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Section 120.05 of the penal law is amended by adding a  new
 subdivision 15 to read as follows:
   15. WITH THE INTENT TO CAUSE PHYSICAL INJURY TO A PERSON EMPLOYED AS A
 MOTOR  VEHICLE  LICENSE  EXAMINER  BY  THE  DEPARTMENT OF MOTOR VEHICLES
 PERFORMING THEIR LAWFUL DUTIES OR IN RELATION TO  THEIR  LAWFUL  DUTIES,
 SUCH PRINCIPAL PERSON CAUSES PHYSICAL INJURY TO SUCH EMPLOYEE.
   § 2. This act shall take effect on the first of November next succeed-
 ing the date on which it shall have become a law.
