2025-A2740 - Summary

Provides that whenever the public service commission denies a request by a utility for a major change in rates or charges, the schedule, rate, charge, form of contract or agreement, rule, regulation, general privilege, facility, or service immediately in effect prior to such request shall remain in full force and effect until such time as the commission approves a new rate, charge.

 AN  ACT  to  amend  the  public  service  law, in relation to denials of
   increased utility rates and charges
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section  1.  Subdivision 12 of section 66 of the public service law is
 amended by adding a new paragraph (m) to read as follows:
   (M) WHENEVER THE COMMISSION SHALL DENY A REQUEST BY A UTILITY  FOR  AN
 INCREASED  RATE  OR  CHARGE,  OR  TARIFF,  OR  ANY CHANGE IN ANY FORM OF
 CONTRACT OR AGREEMENT OR ANY RULE OR REGULATION RELATING TO ANY RATE  OR
 CHARGE,  OR  TARIFF OR SERVICE, OR IN ANY GENERAL PRIVILEGE OR FACILITY,
 THE RATE OR CHARGE, OR TARIFF OR SERVICE IMMEDIATELY IN EFFECT PRIOR  TO
 THE COMMISSION'S DENIAL SHALL REMAIN IN FULL FORCE AND EFFECT UNTIL SUCH
 TIME  AS  THE  COMMISSION  APPROVES  A  NEW RATE OR CHARGE, OR TARIFF OR
 SERVICE.
   § 2. This act shall take effect immediately.

 AN ACT to amend the public  service  law,  in  relation  to  denials  of
   increased utility rates and charges
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Paragraph (j) of subdivision 12 of section 66 of the public
 service law, as amended by chapter 154 of the laws of 1989,  is  amended
 to read as follows:
   (j) The schedule, rates, charges, form of contract or agreement, rule,
 regulation, service, general privilege or facility in force when the new
 schedule,  rate,  charge,  form  of contract, rule, regulation, service,
 general privilege or facility was filed shall continue in  force  during
 the  period  of  the  suspension unless the commission shall establish a
 temporary rate or charge as authorized by section  seventy-two  of  this
 article.  PROVIDED,  HOWEVER,  THAT WHENEVER THE COMMISSION SHALL DENY A
 REQUEST BY A UTILITY FOR A MAJOR CHANGE IN RATES OR CHARGES, THE  SCHED-
 ULE,  RATE,  CHARGE,  FORM  OF  CONTRACT OR AGREEMENT, RULE, REGULATION,
 GENERAL PRIVILEGE, FACILITY, OR SERVICE IMMEDIATELY IN EFFECT  PRIOR  TO
 SUCH  REQUEST  BEING  FILED  SHALL REMAIN IN FULL FORCE AND EFFECT UNTIL
 SUCH TIME AS THE COMMISSION APPROVES A NEW SCHEDULE OF RATES OR CHARGES,
 UNLESS THE COMMISSION ESTABLISHED A TEMPORARY RATE OR CHARGE AS  AUTHOR-
 IZED BY SECTION SEVENTY-TWO OF THIS ARTICLE.
   §  2.  This  act  shall take effect immediately and shall apply to all
 requests by a utility for a major change in rates or charges filed after
 such date.
