 AN ACT to amend the  general  business  law,  in  relation  to  allowing
   licensed  estheticians  and licensed cosmetologists to practice micro-
   needling
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subdivision 6 of section 400 of the general business law,
 as added by chapter 509 of the laws of 1992, is amended  and  three  new
 subdivisions 6-a, 7-a and 12 are added to read as follows:
   6.  The  practice  of  "esthetics"  means  providing for a fee, or any
 consideration or exchange,  whether  direct  or  indirect,  services  to
 enhance the appearance of the face, neck, arms, legs, and shoulders of a
 human  being  by  the  use  of compounds or procedures including makeup,
 eyelashes, depilatories, tonics, lotions, waxes, MICRONEEDLING,  sanding
 and tweezing, whether performed by manual, mechanical, chemical or elec-
 trical means and instruments but shall not include the practice of elec-
 trology.
   6-A. "ESTHETICIAN" MEANS A PERSON LICENSED TO PRACTICE ESTHETICS.
   7-A. "COSMETOLOGIST" MEANS A PERSON LICENSED TO PRACTICE COSMETOLOGY.
   12.  "MICRONEEDLING"  MEANS  THE USE OF A ROLLER COVERED IN VERY SMALL
 NEEDLES TO INSERT VERY SMALL NEEDLES INTO THE SKIN.
   § 2. The general business law is amended by adding a new section 404-d
 to read as follows:
   § 404-D. MICRONEEDLING FIVE HOUR COURSE. 1. ALL LICENSED  ESTHETICIANS
 AND  LICENSED  COSMETOLOGISTS  SHALL  IN ORDER TO PRACTICE MICRONEEDLING
 COMPLETE A FIVE HOUR MICRONEEDLING APPROVED COURSE OFFERED BY A NEW YORK
 STATE LICENSED APPEARANCE ENHANCEMENT SCHOOL WHOSE CURRICULUM  FOR  SUCH
 COURSE  WAS  APPROVED  BY  THE BUREAU OF PROPRIETARY SCHOOL SUPERVISION.
 UPON COMPLETION OF SUCH COURSE, ALL LICENSED ESTHETICIANS  AND  LICENSED

 THAN  THREE TENTHS OF A MILLIMETER IN LENGTH TO CREATE CONTROLLED MICRO-
 INJURIES IN THE SKIN TO IMPROVE ITS TEXTURE AND APPEARANCE.
   § 2. The general business law is amended by adding a new section 404-d
 to read as follows:
   § 404-D. MICRONEEDLING FORTY-HOUR COURSE. 1. ALL LICENSED ESTHETICIANS
 AND LICENSED COSMETOLOGISTS SHALL IN  ORDER  TO  PRACTICE  MICRONEEDLING
 COMPLETE  A  FORTY-HOUR  MICRONEEDLING  APPROVED  COURSE  OFFERED BY THE
 DEPARTMENT OF STATE. THIS COURSE SHALL BE OFFERED BY A NEW  YORK  STATE-
 LICENSED  APPEARANCE  ENHANCEMENT SCHOOL OR OTHER ENTITY APPROVED BY THE
