2025-A3592 (ACTIVE) - Summary

Provides that upon motion and after an opportunity to be heard, a court may order the defendant in a family offense proceeding to turn control of a connected device over to a family or household member or, if that is not possible, to have such connected device disabled by the manufacturer.

 AN ACT to amend the criminal procedure law, in relation to  transferring
   control  of  a  defendant's  connected  devices  in  a  family offense
   proceeding
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subparagraph 8 of paragraph (a) of subdivision 1 of section
 530.12  of  the criminal procedure law is amended by adding a new clause
 (C) to read as follows:
   (C) UPON MOTION AND AFTER AN OPPORTUNITY TO BE HEARD,  THE  COURT  MAY
 ORDER  THE  DEFENDANT  TO  TURN  CONTROL OF A CONNECTED DEVICE OVER TO A
 FAMILY OR HOUSEHOLD MEMBER OR, IF THAT IS NOT  POSSIBLE,  TO  HAVE  SUCH
 CONNECTED DEVICE DISABLED BY THE MANUFACTURER.
   § 2. This act shall take effect immediately.
