 AN  ACT to amend the social services law, in relation to clarifying when
   and how a child protective services report is determined
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision 7 of section 424 of the social services law, as
 amended  by  chapter  164  of  the  laws  of 1991, is amended to read as
 follows:
   7. determine, within sixty days OR AS SOON AS  IT  DEEMS  APPROPRIATE,
 whether  the  report is "indicated" or "unfounded", IF, AFTER CONDUCTING
 ITS INITIAL INVESTIGATION OF THE CURRENT REPORT AND THOROUGHLY REVIEWING
 THE FAMILY'S HISTORY WITH THE LOCAL  CHILD  PROTECTIVE  AGENCY,  (A)  IT
 DETERMINES  THAT  THERE  IS A HISTORY OF PRIOR UNFOUNDED REPORTS OR THAT
 THE REPORT APPEARS TO HAVE BEEN MADE FOR THE PURPOSE OF HARASSMENT,  AND
 (B)  IT HAS NOT UNCOVERED ANY NEW CONCERNS ABOUT THE SAFETY OF THE CHIL-
 DREN DURING ITS INITIAL INVESTIGATION AND DETERMINED THAT THE NEW REPORT
 IS LIKELY UNFOUNDED;
   § 2. This act shall take effect immediately.
