 AN ACT to amend the  navigation  law,  in  relation  to  requiring  that
   vessels used to tow a person display a flag
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Section 73 of the navigation law is amended by adding a new
 subdivision 4-b to read as follows:
   4-B. (A) NO PERSON SHALL USE OR OPERATE A VESSEL TO TOW A PERSON WITH-
 OUT DISPLAYING A FLAG IN A VISIBLE MANNER SUCH THAT OPERATORS  OF  OTHER
 VESSELS IN THE AREA MAY REASONABLY DETERMINE THAT:
   (I) A PERSON BEING TOWED IS IN THE WATER; OR
   (II)  A  PERSON  IS EITHER PREPARING TO BE TOWED OR IS FINISHING BEING
 TOWED.
   (B) THE FLAG REQUIRED PURSUANT TO PARAGRAPH (A)  OF  THIS  SUBDIVISION
 SHALL BE:
   (I) COLORED INTERNATIONAL ORANGE;
   (II) AT LEAST TWELVE SQUARE INCHES IN SIZE; AND
   (III) MOUNTED ON A BOARDING HANDLE OR OTHER SAFETY HANDLE.
   § 2. This act shall take effect immediately.
