AN ACT to amend the general business law, in relation to requiring
private investigators to notify the state police when they are
employed by a foreign government or foreign national and requiring the
state police to maintain a registry of all private investigators who
have been employed by a foreign government or foreign national
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 70 of the general business law is amended by adding
a new subdivision 3-a to read as follows:
3-A. UPON THE ISSUANCE OF A PRIVATE INVESTIGATOR LICENSE OR THE
RENEWAL OF A PRIVATE INVESTIGATOR LICENSE PURSUANT TO THIS ARTICLE, THE
DEPARTMENT OF STATE SHALL NOTIFY THE LICENSEE THAT SUCH LICENSEE IS
REQUIRED TO INFORM THE STATE POLICE WHEN THEY ARE EMPLOYED BY A FOREIGN
GOVERNMENT OR FOREIGN NATIONAL. SUCH NOTIFICATION SHALL BE IN ADDITION
TO ANY REQUIREMENT UNDER FEDERAL LAW REGARDING AN INDIVIDUAL OPERATING
AT THE DIRECTION OF A FOREIGN GOVERNMENT.
§ 2. The general business law is amended by adding a new section 88-a
to read as follows:
§ 88-A. PRIVATE INVESTIGATOR REGISTRY. THE SUPERINTENDENT OF THE STATE
POLICE SHALL MAINTAIN A REGISTRY OF PRIVATE INVESTIGATORS LICENSED IN
THE STATE PURSUANT TO THIS ARTICLE WHO HAVE BEEN EMPLOYED BY FOREIGN
NATIONALS AND FOREIGN GOVERNMENTS. SUCH REGISTRY SHALL ONLY BE OPEN TO
THE ATTORNEY GENERAL AND MEMBERS OF THE STATE POLICE. SUCH REGISTRY
SHALL INCLUDE:
1. THE NAME OF THE PRIVATE INVESTIGATOR;
2. THE BUSINESS NAME ASSOCIATED WITH THE PRIVATE INVESTIGATOR;
3. THE ADDRESS AT WHICH SUCH BUSINESS IS REGISTERED;
4. THE NAME AND BUSINESS NAME OF THE CLIENT; AND
EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
[ ] is old law to be omitted.

5. THE ADDRESS OF THE CLIENT.
§ 3. This act shall take effect six months after it shall have become
a law. Effective immediately, the addition, amendment, and/or repeal of
any rule or regulation necessary for the implementation of this act on
its effective date are authorized to be made and completed on or before
such effective date.
