 AN ACT to amend the public health law, the tax law,  the  real  property
   law  and the multiple dwelling law, in relation to enacting the "Lead-
   Free Homes Act"
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Short  title. This act shall be known and may be cited as
 the "Lead-Free Homes Act".
   § 2. Section 1370 of the public health law, as amended by chapter  485
 of  the laws of 1992, subdivision 6 as amended by section 1 of part P of
 chapter 57 of the laws of 2019, subdivision 8 as added by section  1  of
 part T of chapter 57 of the laws of 2023, is amended to read as follows:
   §  1370. Definitions. When used in this title, the following words and
 phrases shall have the following meanings, unless  the  context  clearly
 requires otherwise:
   1.  "Dwelling"  means  a  building  or  structure  or portion thereof,
 including the property occupied by and  appurtenant  to  such  dwelling,
 which is occupied in whole or in part as the home, residence or sleeping
 place of one or more human beings [and shall, without limiting the fore-
 going, include].
   2.  "SCHOOL"  MEANS  ANY  PUBLIC OR PRIVATE child care [facilities for
 children under six years of  age,  kindergartens  and  nursery  schools]
 FACILITY,  CHILD  CARING  CENTER,  DAY NURSERY, DAY CARE AGENCY, NURSERY
 SCHOOL,  PRE-SCHOOL,  PRE-KINDERGARTEN,  KINDERGARTEN,   OR   ELEMENTARY
 SCHOOL.
   [2.]  3.  "Area  of high risk" means an area designated as such by the
 commissioner or [his] SUCH COMMISSIONER'S representative and  consisting
 of  one  or  more dwellings OR SCHOOLS in which a condition conducive to
 lead poisoning of children is present.
