 AN ACT to amend the education law, in relation to allowing school  prin-
   cipals in the city of New York to hire coaches who are not also teach-
   ers
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Legislative findings. 1. The legislature finds that a well-
 rounded education includes opportunities for students to excel not  only
 academically  but  also  athletically,  fostering character development,
 discipline, and teamwork.
   2. The legislature further recognizes that diverse coaching  expertise
 enhances  the  quality  of  student-athlete  training and contributes to
 their overall growth,  potentially  leading  to  improved  athletic  and
 academic achievements.
   3.  The  intent of this legislation is to empower school principals to
 make informed decisions regarding coaching  appointments,  allowing  for
 the  selection of qualified individuals who possess the necessary skills
 and passion to inspire and guide student-athletes.
   § 2. Section 2573 of the education law is  amended  by  adding  a  new
 subdivision 18 to read as follows:
   18. (A) IN A CITY HAVING A POPULATION OF ONE MILLION OR MORE, NOTWITH-
 STANDING  ANY OTHER REGULATION, POLICY, COLLECTIVE BARGAINING AGREEMENT,
 OR PROVISION OF LAW, EACH SCHOOL PRINCIPAL SHALL HAVE THE  AUTHORITY  TO
 HIRE  COACHES FOR ANY SPORT WITHIN THE SCHOOL OF SUCH PRINCIPAL, REGARD-
 LESS OF WHETHER THE PROSPECTIVE COACH IS A CURRENT  TEACHER  WITHIN  THE
 SCHOOL SYSTEM. COACHES HIRED PURSUANT TO THIS SUBDIVISION SHALL MEET THE
 QUALIFICATIONS  SET  FORTH  BY  THE  RELEVANT ATHLETIC ORGANIZATIONS AND
 SHALL BE SUBJECT TO ALL REQUIRED TRAINING  AND  CERTIFICATIONS  FOR  THE
 SPORT THEY WILL COACH.

   (B)  THE  DEPARTMENT OF EDUCATION OF THE CITY OF NEW YORK SHALL ESTAB-
 LISH GUIDELINES FOR THE HIRING OF COACHES UNDER THIS  SUBDIVISION.  SUCH
 GUIDELINES SHALL CONSIDER ALL RELEVANT FACTORS, INCLUDING BUT NOT LIMIT-
 ED TO:
   (I) TRANSPARENCY;
   (II) FAIRNESS; AND
   (III) COMPLIANCE WITH ALL RELEVANT REGULATIONS.
   (C)  THE DEPARTMENT OF EDUCATION OF THE CITY OF NEW YORK SHALL MONITOR
 AND SUBMIT AN ANNUAL REPORT ON THE IMPACT  OF  THE  PROVISIONS  OF  THIS
 SUBDIVISION. SUCH REPORT SHALL BE SUBMITTED TO THE GOVERNOR, THE SPEAKER
 OF THE ASSEMBLY, AND THE TEMPORARY PRESIDENT OF THE SENATE NO LATER THAN
 JANUARY FIRST, TWO THOUSAND TWENTY-SEVEN AND ANNUALLY THEREAFTER.
   § 3. This act shall take effect immediately and shall apply to academ-
 ic years beginning on or after such effective date.
